Things to Know about your TIN

Doesn’t know how to cook really by was able to be so with the Rat on his head guiding him thru the difficult task of preparing food with extra ordinary taste even the astounding the most difficult food critic.  The article has nothing to do with being a chef. But the information can be the Rat on your head so to speak which will give you a better understanding on your TIN and the process of updating and transferring which you may be required to do as the need arises.

 If you have a TIN but you lost it in some way, or just couldn’t remember what your TIN number is or you are not sure if you have a TIN and you would like to know if you do have one.  All you need to do is to call BIR TIN Verification Office at 926-8339 this is their updated number or the BIR Contact center at 981-8888 or email contact_us@cctr.bir.gov.ph, just make sure you provide your full name, and birthdate.

Make sure to check first if you do have a TIN under your name and address.  If you have a new home address and you wish to change it then you can update your TIN information thru BIR Form 1905.

Also you can use this form to apply for a TIN Card if don’t have one or you lost your original card.  If you lost your card the only attachedment you need would be an affidavit of loss. In the form 1905 in PART II “REASON FOR REGISTRATION INFORMATION UPDATE” please check box “B” - “Replacement of lost/Damaged TIN Card”

Then scan down look for for “4B”  ”REPLACEMENT OF LOST / DAMAGED TIN CARD” and check the appropriate box for you.  If you have a damaged TIN card the requirement will be your old TIN Card so BIR can replace it for you.  Again if you lost your TIN card then the requirement is an Affidavit of loss.

For New applicants for TIN card no attachement is required. Just check the box of letter “K” in Part II of BIR Form1905  which says “OTHERS (Specity)” and write down what you need “TIN CARD” in the line provided.  

Of course if you are requesting this then it should be clear to you that you already have a TIN NUMBER issued by a particular BIR Revenue District Office (RDO). And you are submitting this BIR Form1905    to that RDO who issued the TIN number or where that TIN number is currently registered.

Please take note that if your TIN is not registered in the RDO where you wanted to submit your application form 1905,  they cannot or will be unable to process your request.

So remember to check where your TIN is currently registered thru the numbers provided above. Know the location of the RDO where your TIN is currently registered then proceed to that office.

This process is too much hassle. In my case, my TIN was registered to RDO 57 which is in Binan, Laguna because my first company. Since I lived in Metro Manila, I went to the nearest BIR Office as expected they can’t process your TIN Card and RDO Update. They asked me to go to Binan, Laguna to get one. I read cases like this in other forums which someone lives in Visayas but his RDO is somewhere in Luzon. I hope with the new BIR head Joel Tan address this case. Kawawa naman yung nakatira sa malayo. It’s acceptable if the RDO is within Metro Manila but it it’s located in different province, it’s hard.

Yung perang ikakain mo sana, nauwi lang sa pamasahe at nasayang pa oras mo.

Thank you for airing us your concerns. It is indeed problematic if your TIN is registered in another province. This is why we try to inform as many people about this so they can take steps in transferring their to the nearest BIR RDO where they plan to work. But there is a another solution for this. You can actually FAX your application form 1905 for transferring your TIN to the BIR RDO which has jurisdiction over the area where you are currently working. So after your TIN is transferred to the BIR RDO near your place of work you then request for a TIN card with that office. Using also the BIR Form 1905.

The number of TSS unit in RDO 57 is 511-9010 you can call them up to assist you with your request for transferring your TIN. So before faxing to them your 1905 call them first ask the person who will assist you. Here’s their fax numbers are (02) 5208262 local line for Manila residents and (049 )511-9797. Again after faxing call them up again to know if they receive your fax. You may want also to ask when they can transfer your TIN. So when this is done. You can go to the BIR RDO office where you requested your TIN to be transferred and apply for TIN Card. Hope this would help. Thank you and good day.

hi gud evening, I aM writing/asking in behalf of a close friend, since he will be working in one of the major call centers here in the manila area, the H.R. representative handed him B.I.R. form 1905, the H.R representative told my friend to ask his former employer about its three digit RDO, so the funds will be transferred to the call center’s RDO. The issue is, my friend did not include all his previous employers in his resume to avoid the hassle of too many Certificate of employments and to avoid too many questions from the new employer’s H.R (:, His recent job was supposed to be from a hotel in q.c., his contract ended May 2009, since he did not pass the probationary period, but my friend only put his recent job as school teacher which was early 2008, The questions are, Wat does RDO stand for? Can my friend ask for the RDO of his previous employers not listed in the resume? Will the call center find out,? my friend ’s former employers never asked him for the RDO nor any 1905 forms ever. please help.

On your first question, The RDO stands for Revenue District Office of the BIR. There is an RDO who has a certain jurisdiction of a particular area. When your friend first applied for a TIN, there was an RDO who issued that TIN to him and thats where his TIN is currently registered. Second question, if understand it correctly. Lets be clear the RDO is not usually indicated in any resume. The HR is requiring your friend to file the BIR form 1905 because the TIN of your friend might not be registered with the RDO where that company is currently registered. For example the company is located in Pasig. That would be RDO 43 of the BIR but the TIN of your friend is in another RDO where he first got his TIN lets say his first job was in company located in Cubao. RDO 40 has jurisdiction over that area. So he should file the BIR Form 1905 to RDO 40 where his TIN is currently registered, to transfer it to RDO 43. Some employers would not ask this because the case might that those former employers are also registered with the same RDO where the TIN of your friend is also registered. IN the 1905 form at the bottom portion, you are required to fill the RDO number of your old RDO or the current RDO where the TIN of your friend is registered and the NEW RDO where you will transfer the TIN registration. So your friend should ask the new office on which RDO they file their taxes.

Good day! My current employer handed me a BIR 1905 Form. I understand that I should ask my previous employer for the RDO code. The problem is, I was as AWOL on that company (IBM-Daksh). Can I still ask them for the RDO code though? I will work in TP which has RDO 043. Or, is there any way for me to know the RDO of my previous company without asking them? Your response will be greatly appreciated. Thanks.

No, you don’t need to ask your previous employer of your RDO code or the Revenue District Office where your TIN currently registered. This article provides the contact number where you can get this info. Call BIR TIN Verification Office at 981-7000 local 7030 or the BIR Contact center at 981-8888 or email contact_us@cctr.bir.gov.ph.

Hi, I would like to ask if there’s any way that I cna retrieve my TIN I got it from my previous employer which is Telus International Philippines (call center). I tried asking them of the RDo and if they have my number, They where my first employer, i receive no response form them. I called the Contact Center of BIR and I spoke to a guy he said that BIR has no records of my name or number. He only asked for my name, Ma. Theresse Zafra was my name registered under my TIN birthday is July 06, 1989. I hope to hear from you soon, I also emailed your contact center. I really need my TIN so I cna start working. If the Contact Center of the BIR hasn’t responded to you yet on this matter let me know. If you indeed have no record under your name then you need to apply for a TIN using 1902. This usually happens as personnel of companies tasked to do this aren’t really doing their jobs. Sometimes giving even bogus TIN only to find out by those employees later when they try to verify or update their TIN. Its is wise to follow up TIN with your office immediately if they indeed have done it for you. If they say they did but cannot give you the TIN then call BIR, if you found out that they haven’t filed one then its up to us to file for a TIN. This is unfortunate but things like this does happen. There is no BIR policy between employer and employee on who will get the TIN. Because there are companies who do not have the man power to give this service to their employees, In which in this case the employees personally apply for their TIN.

i have a problem. i was mistakenly registered as non-employee by a friend. i should be registered as an employee. now, i have to pay P500 for my TIN. what should i do?

First, why are you being ask to pay P500? unless you were registered thru 1901 for SELF EMPLOYED most probably as a professional or an agent of some insurance. You don't have to pay, because if you do, you are already telling BIR to go ahead with that registration as SELF EMPLOYED. But please be AWARE that once you have a TIN whether you got it thru first as SELF EMPLOYED or AS AN EMPLOYEE … that TIN is already yours for WHATEVER purpose you may need it. Meaning you can only have ONE TINE thats it. Whether you got it thru as an EMPLOYEE OR YOU GOT IT THRU AS A SELF EMPLOYED individual. Now again don't pay the P500 since you are employed you can use the BIR Form 1902 attach photocopy of your birth cert. pass this to the BIR Revenue District Office (RDO) where your current employment is also registered. Get the number of the attending personnel to call when or what is the TIN# assigned in your name. Thats it.

Hello po. I am registered at Paranaque but I work in Taguig. This is my first job and I started only last November. I went to BIR Taguig city to file my ITR but they said I should file it in Paranaque because I’m registered there and my BIR form 2305 (update of employer) was filed by my employer 2010 na so it is effective 2010. But since I’m filling for my 2009 income, I should file it in Paranaque. Are these procedures correct? If not what should I do. Thank you.

Yes Melissa, if your TIN is currently registered in Parañaque then the BIR Taguig office cannot touch or accept your request because they cannot access it only view it as some may say. So they would advise you to go to the said RDO where your TIN is currently registered. Your employer filed your BIR form 2305 in Taguig most likely and again even if BIR Taguig accepted it, but when they find that your TIN is not registered with them, they cannot process the said application. You need to request your TIN registration to be transferred using form 1905 from BIR Parañaque to BIR Taguig. Naturally, you need to file this with your current RDO which is BIR Parañaque as you said. So they can transfer your TIN to Taguig so that BIR Taguig can now accept your application for update thru BIR form 2305. Should you have any other concerns please drop a message. Good day.

HI! Thanks for your reply. So for now, I have to file my BIR 1905 which is request for transfer for RDO? So it’s okay even if I live Paranaque, I will a request for a transfer to Taguig because I work there? Then that’s the only time I can file BIR 2305. But then again, I will file 2009 ITR still in Paranaque? Thanks again.

and thank you also for visiting my site. Yes, need to do this. If you have transferred your TIN to BIR Taguig then this is the only RDO which can accept your tax return. If BIR Parañaque has already made the transfer then they cannot process or accept the return because your TIN registration is no longer in their jurisdiction but with BIR Taguig. It is only during the last day of the filing season which is April 15, that the BIR Commissioner will allow Taxpayers to file & pay anywhere through a memorandum. Meaning one can file & pay with any Revenue District Office of the BIR or its Accredited Agent Banks. For that day only. But it would be wise to file EARLY. To avoid the rush or hassles that may come with it.

Hi! I found this site really informative and I have a question of my own; about 2 years ago I worked at a call center but went AWOL… I’m pretty sure they got me a TIN so I went to the nearest BIR office in my area (quezon ave.) when i went to verify my TIN I was surprised to find my exact same name in the computer (first middle and last) only to find that the birth date of that person is different from mine. I’m pretty sure that they just made a mistake in filing the birth date and that I am the person registered under that TIN I saw. But the guy from BIR said that the TIN wasn’t mine because of the different birth date and I should just get my future employer to get me a new TIN (since I’m planning to apply for a job next week). What should I do? Should I submit a form or something that could change the birth date of that TIN or should I just let my future employer get a new TIN for me? A quick reply would be much appreciated… thanks.

Thanks also for visiting. Will be posting more information that you may need in the future. Anyway, If the name matches yours but the birthdate is in not yours. The next information you need to check is the address under that name if it matches yours. Usually the address in the TIN info does not reflect your home address some have used the address of their office but if the address is your home address then the TIN is most probably yours. Or if the address is is the address of your previous office then this would be another consideration that the TIN is yours. I’ve just updated the contact number of the BIR TIN Verification Office which is now 926-8339. Try calling them up. You should apply only after verifying this thru the said number using the detail i mentioned. Which is the ADDRESS under that TIN. Now if the result will turn out negative then thats the time you can apply for a TIN using BIR form 1902. There’s an article on this on the left side of this blog.

Yes, the BIR Form 2305 can only be submitted to the RDO where your TIN is currently registered. If you think your old RDO is where your TIN is currently registered then you can submit that application form to the said district. I would likewise advise you to call the BIR TIN verification office or the BIR Contact Center in the numbers mentioned in this article. So you can be sure that your TIN is registered in that RDO. BIR Form 1902 ang gaggamitin mo. Meron dun portion para dapat fill-up ng authorize representative ng office ninyo bago mo ito submit sa BIR Makati. hello. in relation po ito dun sa tanong ni genesis nung march 8. ako po ay dating empleyado sa isang government hospital mula 2006-2008. sa aking pagkakaalam, ang hospital po ang naglakad para kuhanan ako ng TIN (nag-submit po ako ng 1902 sa kanila). Ito po ang aking naging unang trabaho at never pa po akong nag-apply ng TIN dati.

Nung akin pong tawagan ang TIN verification center, sinabi po sa akin ang aking TIN at kung saang RDO ako nakaregister. Dahil po gusto kong lumipat ng RDO (dahil sa paglipat ng tirahan), nagsubmit po ako ng 1905 dun sa RDO kung saan ako nakarehistro ngayon. Nung nag-check po sila ng records nila, ang sabi po sa akin ay mayroon daw pong mga pending cases sa aking TIN/pangalan. Dahil according po sa records nila, nakaregister daw po akong VAT-professional since 2006 at wala daw po akong na-file na ITR at mga VAT payments.

Ang problema ko po ngayon ay wala po ako nung mga yun. Dahil empleyado lang naman po ako nung mga panahong iyon at di professional. Di po ako nag-file ng 1700 dahil iisa lang aking employee so yung 2316 ko ang ginagamit ko bilang ITR. Ang sabi po sa akin ay either bayaran ko ang mga penalties, o i-contest ko yung findings.

Ang tanong ko po ay ano ang aking gagawin? Ang sabi sa akin ay mukhang ang aking TIN ay nagenerate sa internet kaya di na nila machecheck kung sino ba talaga ang nagpagawa ng aking TIN. Papaano ko po kaya ito maaayos?

Sorry po sa aking mahabang comment. Medyo naguguluhan lang po kasi ako talaga. Sana po ay mabigyang linaw ninyo ang aking problem.

This is such a helpful site. And the moderator is friendly. I would like to know if TINs acquired online (when this was still available at the BIR web) for purposes of getting a driver’s license and transacting business with the government (E.O.98) can be used when that individual is subsequently employed. I understand an individual can only be issued a TIN ONCE. My son, however, did not go to the RDO-052 Paranaque to register his one-time TIN but eventually used the same number when he was employed. Is there any complication to this?

Hi, I’m having a difficult time understanding the TIN process for employment. I got my TIN four years ago for my driver’s license online. Recently, I went to the BIR Muntinlupa (RDO 53B) to file my withholding tax form, and they told me that I can’t use my TIN yet because it was under EO98. The personnel was kind enough to transfer me to RDO 44 in Taguig, since that’s where I work. A couple of questions:

1. Since my TIN was transferred to Taguig, does this mean that my TIN can be used (i.e. not under EO98 anymore?) or do I have to do anything to “activate” it? I really need to do this so that I can file my withholding tax.

2. Where exactly is the Taguig BIR office? The BIR site says it’s in the FTI complex, while the link in this site says it’s near St. Luke’s in the Fort…

Hello Bong, i’m sorry di ata na post yung sagot ko nun. I remembered answering your query couple of days ago but it seems hindi pumasok. But anyway, with regards to your problem you need to update and correct your registration with your RDO. Tell me which RDO you belong. I contacted RDO 38 to ask them pertaining your problem and they said that you should correct your registration. The pending cases was generated by BIRs computer program based on your registration as a professional so contest the findings based on the true nature of your job as an employee not as a professional. Your 2316 certified by your employer is proof that your are indeed an employee. If you have other employment documents so much the better. The BIR has a Taxpayer Assistance counter check this out and ask for this assistance in correcting your registration. Let me know of your progress. Good day.

No complication that i know of but your son needs to update his registration with the said RDO. TIN thru EO98 can be used for applying for a drivers license. When the TIN is used for employment your son should update his registration using the 1902. If your son gets married and has a dependent child he will likely need to apply for an update thru 2305 to get the additional exemption for his child. Once he does this the BIR RDO will know that the TIN used by your son was acquired based on EO98 so he will likely be ask to update first the TIN as an employee. The BIR has setup a Tax Assistance counter for taxpayers who would like to update their TIN registration. Should you have any problems regarding this please let me know.

Hi Jerry, you said you work in taguig area. So i take this that you are employed. if your TIN was updated thru 1902 before it was transferred then your TIN is valid for filing ITR. But since your employed i know that your employer is the one who should give you a 2316 form which usually serves as the ITR of employees and if you only have one employer for the entire 2009 taxable year then the 2316 certificate automatically serves as your ITR. The one attesting here is the employer. Anyway, your TIN was transferred without being updated thru 1902 the RDO in taguig may require you to update your registration using 1902. Documentary requirements for this would be your Birth cert., if married then your marriage cert.

BIR Taguig was previously located in FTI complex. The locational map links of this blog points to the 3rd floor Bonifacio Technology Center, 31st St. corner 2nd Ave., Crescent West Park, FL Bonifacio Global City, Taguig City. There numbers are 856-0553 and 856-7531. The address in the BIR website which you might have accessed is not yet updated. I provided RDO Taguig’s numbers so you can contact them for more information on their exact address.

Hi, I got my TIN from my previous employer, and now my new employer is asking me to transfer my home rdo. I went to my prevous home rdo and asked for a transfer by submitting 1905. When the BIR personnel checked my records, they found out that the status of my TIN number is OPEN CASE. The personnel told me that I should get an employment certficate from my employer of the period that I was in OPEN CASE status. Unluckily, the prevous company was dissolved and thus they cannot issue an employment cert for me. The BIR personnel told me that unless the status is not closed, I will not be permitted to transfer.

What is an OPEN CASE STATUS by the way? How did I arrived to be in the an OPEN CASE STATUS? How will it close?

Please help.

Hi! My previous company is in RDO #38 and Im now currently working here sa Makati. Kaya lang naka-register kami under CEZA. I need to update my status kasi I just got married pa lang. Ayaw ko sana ipalipat yung RDO ko sa Cagayan i-retain na lang sa QC. Is that possible? Pwede ko ba syang i-update na rin dun? Saan po yung RDO #38? sa may BIR ba yun na malapit sa SSS? Pls help!

Hi Genaro, if you have an open case then i take it you registered as a PROFESSIONAL thru online registration. Is this the case with you? if it is then thats why you have an OPEN CASE because as a registered professional you are telling BIR that you are DISPENSING your professional services for a fee and not as an EMPLOYEE. As a registered PROFESSIONAL the BIR automatically generates reports on required Tax that a PROFESSIONAL are REQUIRED to file. You need to CORRECT your registration with the BIR. Ask the Tax Assistance counter of your RDO to help you out. You may need to produce a BIR 2316 certificate issued by your previous employer if you were unable to get this and your employer is no longer around to give this to you. Then you may need to execute an affidavit attesting that this was so and you need to correct your registration because you are NOT ACTUALLY A PRACTICING PROFESSIONAL but an EMPLOYEE. Hi melissa, yes you cannot update your registration with the RDO who handles CEZA area. Yes it is possible but if you need to update your registration you have to go to RDO 38 to request for that update. I have a locational map of RDO 38. hello. sa RDO 30 po ako. Naging maayos naman po ang naging interaction ko sa mga BIR personnel. at kung ano po yung sabi ninyo ang pinagawa po sa akin. Inaayos na naman na daw po yung mga kaso ko. yun nga lang, aabutin pa raw po ng ilang buwan bago kumpletong maayos dahil papadala pa nila papeles ko sa national office. sila daw po kasi ang mag-close ng mga kaso. maraming salamat po sa tulong ninyo.

Hello Genaro, no you don’t need to pay it since you never really were practicing your profession in the first place. If you do your telling BIR that they were correct in imposing the penalties and you are indeed a professional and you will likewise be required secure Official Receipts for your profession.

hello i have a problem, i recently resigned from my work to transfer in another company. I inquired BIR for my tin number and was shocked to know I don’t have any yet. Since my new company is requesting one, I gave them 1902 for them to apply for me. I also told my former HR that I don’t have any TIN records in BIR. She said she will verify it with someone. She also said i can apply for new one in my new employer.

Is it possible that they didn’t apply for me while I was working for them since I resigned two months after I was hired? Also, I want to avoid having two TINs since it is punishable, what if they still apply for me even if i’m not working for them anymore so that they wouldn’t be punished for not taxing my income? And lastly, Is it sufficient to verify if i have TIN record in ANY RDO?

Hi Jack, it would wise to check with TIN verification office and the BIRCC for double checking. Get the names of the personnel who assisted you and note the day and time you inquired. So there should be no question if you have a TIN or not. Then you can apply for a TIN if indeed you don’t have one.

It is possible because not all offices apply for TIN for their employees. It depends on the employer if they have the manpower to do this for their employees. Again getting a TIN is not the responsibility of the employer but by the employee who needs it.

Please take note that under substituted filing your employer is mandated to withheld tax from your pay whether you have a TIN or not. Another point to know is that the TIN number is NOT like a bank account number or like that of the SSS system. Under the said policy i mentioned the employer is likewise required to give their employees a certificate or the BIR Form 2316 in w/c the employer attest under penalties of perjury that they withheld and remitted the tax of their employee.

This certificate is usually given after the end of a taxable year. In your case you resigned from your old employer. I must advise you to get the BIR 2316 signed by your old employer for the taxes withheld from your pay. I believe this is also required by your new employer so they can continue and record your tax payments so that after the end of this taxable year 2010 they can give you your 2316 consolidated for the entire taxable year of 2010. Which should be filed on or before April 15, 2011.

If they withheld tax for your pay they should give you a certificate thru BIR form 2316. This is how we know they have paid our taxes with the BIR.

Hi Anne, RDO 40 is not located in Cubao it rather handles Cubao area. Check out the BIR Locational Map at the left side of this blog. Click this link and yoou’ll find the locational map for this office. Under Revenue Region No. 7. It is in Quezon Ave. cor. Sct. Santiago.

Pertaining to correction of TIN registration there is no process fee that i know of.

Yes, you cannot transfer if you have an open case record with the BIR. I take it that you registered online as a “PROFESSIONAL”. If you read clearly the details once you register as one thru online registration you are required to pay 500 pesos for registration. After which you will need to request for authority to print receipts because with BIR when you register as a PROFESSIONAL you are actually TELLING BIR you are DISPENSING your PROFESSIONAL SERVICE for a fee and NOT AS an EMPLOYEE who receives COMPENSATION from an EMPLOYER. Once registered as a PROFESSIONAL you are already REQUIRED to FILE AND PAY TAXES on a regular basis prescribe for PROFESSIONAL under the BIR POLICY. This is why you have an OPEN CASE. If you applied online you should have noticed the REQUIREMENTs when you went thru that online application. Anyway, if my assumption in your case is accurate.

You need to CORRECT your registration with your RDO where your TIN is currently registered. Show proof of your employment. There’s a Taxpayer Service area where you can find assistance with this problem. If you have any other concerns do just post it here.

Hi Manu, after you made the correction on your registration i presume that this case will be closed eventually. But the process may take a bit long. Because due to the check and balance efforts of the BIR to curb corruption in its ranks. The approval to close will pass thru higher offices of the BIR. I suggest that in you application to correct your registration. Attach documents to show proof of your employment or execute a legal document or affidavit duly notarized attesting that you are employed and you made an error on your registration which needs to be corrected. And that you never dispensed your professional services outside of your employment.

Hi Marc, you don’t need to close your TIN or you DON’T need to apply for another one. You can correct this thru 1905 form. Click the link of this form provided in this article so you can better appreciate what i will be saying. In this form in Part II check letter “K” and write in the box provided “CORRECTION OF BIRTHDATE” and attach a certified true copy of your birth certificate. File this request to the BIR RDO where your TIN is currently registered.

Why is this process so tedious - i.e., the TIN has to be tied to a specific RDO and you have to get your replacement TIN card from the RDO that originally issued the TIN? In this century, people expect that records are in a centralized database negating the necessity of having to physically travel to another province just to get a replacement TIN card. The procedure that the BIR currently implements is so inefficient.

In your Nov 24, 2009 post, you said that “You can actually FAX your application form 1905 for transferring your TIN to the BIR RDO which has jurisdiction over the area where you are currently working.”

I have several questions related to this. I have a TIN that’s registered in Calamba (RDO 056). I haven’t filed my ITRs in several years because I was out of the country as a graduate student. I have now returned and I can’t find my TIN card so I would like to get a replacement. I have no CURRENT employer. I would like to change the RDO to the RDO in Makati (where I am currently staying/living. I may or may not be working in Makati in the future). I do not want to wait until I am employed to get a replacement TIN card because I need my TIN card for ID purposes.

My questions are:

1. Do I have to be currently employed in order to specify a new RDO where I would like my TIN to be transferred?

2. When I fill up FOrm 1905, what do I check to indicate that I would like to change RDO? There’s no option in Part II (Reason for Registration Information Update) for changing RDO. I assume that “E - Change in Registered address” is for businesses, based on the list of requirements for it on page 2 of the form. So, do I check “K - Others” and then write “Change in RDO”?

3. What do I write on page 2 for “Title/Position of signatory” if I am unemployed? “N/A” or “not employed”?

4. What is the fax number of RDO 056 (Calamba)? Please also say if the number is a dedicated fax number or a telefax.

5. Does the Calamba RDO have a Manila phone number?

Just want to clarify… you can only have ONE (1) TIN no. ?? Which means the TIN no. I used on my driver’s license must be the same as the one used in my income statement(employee) ?? This also applies for land titles, etc.. ?? … thank you…

Hi Madr, thank you for airing your concerns. We likewise want that the system be improve to that point. But as of now we have to work with the current system. We should understand that to change and improve the current system requires a very large capital outlay and approval for such project is not with the BIR but with our government. The BIR handles a much wider scope than any corporations in the land. It does not only handle small businesses or big corporations but also government offices of the entire Philippines as well. Including every worker employed in a certain office. The BIR Commissioner has pointed out the BIR in the 80’s (not sure about the exact year) had a goal of around 80 billion with a staff of a little below 11K. Now the goal is around 800+ billion while the manpower remains at the same level. The BIR has long made this request for additional manpower and hopefully this year our government will grant the additional staff it needs to cope with the gargantuan task of collecting revenue our government and country needs and likewise improve the services we all want to have. Hi Karina. For your first question the answer is no. YOu can transfer it even if you do not have a job yet.

Second, fill out 4E its at the bottom of BIR form 1905. Check No. 1 TRANSFER OF HOME RDO. Your Old RDO write RDO 56 which you said is where your TIN is currently registered. Now know which barangay you are in Makati. There are 4 RDOs handling Makati. RDO 49 North 856-6793, RDO 50 South 811-4492, RDO 48 West 856-5848 , and RDO 47 East 856-6818. Each of those RDO handles specific barangays in that area. Ask them so you know which RDO you should transfer your TIN.

Hi Ramon, yes you are correct. The TIN you used for your drivers license should also be the TIN you are using in your employment. We should only have one TIN for our use in any transactions you may need in the future.

Hi, I need help. I’ve been working in this company for 15 months now. As this has been my first job, the company took the task of getting us, the new employees, a TIN. Just recently, I needed and asked the company for my 2009 ITR. Alas, it turned out they did not, or they weren’t able to, secure us a TIN. My question now is what should happen to the Tax deductions from our salary the entire year of 2009? From what I understand, the filing of ITR for 2009 has already lapsed (April 2010). Does that mean we should demand to get back the Tax deductions?

Hello Naive, whether you have a TIN or not an EMPLOYER is required to withheld tax from their EMPLOYEEs compensation under the SUBSTITUTED FILING policy of the BIR. The TIN should be mistaken as the same in character as with an SSS No. or Bank Account Number. Again under the said policy of the BIR, an employer is LIKEWISE REQUIRED to give a BIR 2316 form certificate in which it is the EMPLOYER or its AUTHORIZED REPRESENTATIVE who will sign that form under penalties of perjury not the BIR. which will serve as the ITR of an employee if that employee has only one employer for the entire taxable year 2009. Now if your employer is saying they didn’t file and pay tax that they deducted then they are liable for willful evasion of paying the tax. Employees can file a complaint with the BIR so they can act on this matter. Our taxes is for our government and we cannot claim any such refund not unless the tax withheld is greater than the tax due. Again if you employer has not remitted to BIR the taxes they deducted from you, because they could not give you the BIR 2316 certificate then you should inform BIR on this so they can properly investigate the said matter.

I am currently under RDO 081 and would like to transfer to RDO 87. I had open cases resulting from a business which i did not formally close years ago and has settled it already. After receiving the clearance from 081, I filed a new business under 087 but they would not allow me to do so since my registration as they say has not been transferred yet in their system. When I called RDO 081 about this, they said that there is a RMO stating that all transfers will take effect at the end of the year. My concern is, RDO 087 will not allow me since they do not know of any RMO about this, and said they would wait until my TIN is in their system. I would want to register my business to avoid penalties but they will not allow me to reg.

Is there an RMO for this? Can I start my business even if my registration is still in 081? Please enlighten me on this matter. More power.

Hi, need help. I just found out that I am using wrong TIN number. I’ve been working for years for several companies and do not know since when I’ve been using the wrong TIN number since I only follow what is written in my ITR given by my employers. I moved to another company and was asked to change my RDO (I was never asked by previous employers to do this), this is when I discovered that I am using wrong TIN number. I asked BIR Call Support, and was advised to simply write the correct TIN number on Form 1905. That there won’t be any problem even if I have successive employer within the year (2 companies in a year). Is it true? Can you confirm that the BIR Call Support suggestion is valid, that it won’t cause me any problem. Additionally, since ITR for 2010 has not yet been released…can I simply ask my previous employer to use my correct TIN number? Thanks.

It is entitled PROCEDURES IN HANDLING TAXPAYERS REQUEST FOR TRANSFER OF REGISTRATION.

This RMC also provides the RMO 11-2005 amending certain procedures of RMO 40-2004.

I hope this information will help you. Just advise the RDO 87 on this. I don’t know why they are not aware of this regulation. The RMC states clearly “the Bureau cannot prohibit taxpayers from transferring their business address”

Hi She, the advise of the BIR Contact Center is correct. Even if you do not have a TIN the employer is required under SUBSTITUtED FILING to withheld tax from your compensation and likewise required to give you the BIR 2316 at the end of a taxable year or when you transfer to a new employer.

The certificate issued to you even if the TIN is incorrect does not invalidate the certificate because it is your employer who is the one attesting to the correctness of the certificate under penalties of perjury. Even if the TIN number is incorrect …what is important is the details of that certificate under your name. The best thing to do now is to use the TIN under your name.

I went to RDO 40 (that’s the branch where my TIN is registered by my previous employer eTelecare).

They didn’t process my request for TIN ID because they say that they do not release ID’s to individuals, they only release ID’s to business owners and company representative.

I have few friends that are registered at other RDO branches but they manage to get their own TIN ID by themselves.

Is there any way I can get a TIN ID?

It is also indicated in my post:

For New applicants for TIN card no attachement is required. Just check the box of letter “K” in Part II of BIR Form1905 which says “OTHERS (Specity)” and write down what you need “TIN CARD” in the line provided.

No Attachment is required for NEW APPLICANTS for TIN CARD.

I don’t really know why they would say that. The TIN Card is proof that you have a TIN number under your name. And it is required in almost all government transactions. From transferring properties, to requesting for a drivers license etc.

You can use your TIN Card as the need arises. A lot of Employers require their employees to produce proof of their TIN. So it would be good if you have one already.

RR 5-2010 nor RR 11-2008 does not state anything that TIN will be release to business owners or company representatives. The TIN is not OWNED nor registered to these business owners or company. It is ours.

Sorry for the late reply. It seems that my answer was not posted. Anyway, you can apply for TIN even without work yet. But if you intend to find a job. I would suggest you apply for a TIN using 1902.

Getting a TIN using 1904 is for people who do not have work but needs to transact with a government office. Like opening a bank account or applying for a drivers license etc.

If you use this for work. you may need to update it still using 1902. So its better to get your TIN thru 1902.

Hi Mariza,
Your TIN remains to be under your name. when you registered your business using that TIN. It still remained under your name including your business.

Your problem is not your TIN. Batay po sa sinabi mo. Never kamo nag operate itong business mo. But you have to understand that when you registered your business. You are required to file and pay taxes required by the RDO where you are registered.

So malamang po kung hindi kayo nagpa file ng returns or informed the BIR RDO of none operation hindi po nila nalalaman kung ano na po ang ginawa ninyo sa inyong business.

When you registered your business in the first place it points out your intention to operate it. If you decided not to continue the said business you should have informed BIR that you wished to close your business.

Ngayon po kung hindi ninyo nga nagawang ipaalam ito sa BIR RDO ninyo malamang po meron kayong mga open cases na kelangan ninyong i-settle.

Puntahan ninyo ang opisina ng BIR kung saan kayo nagparehistro po ng inyong business, alamin ninyo ang dapat ninyo i-settle at magrequest kayo na nais ninyong i-close na ang business ninyo. Kelangan ninyong gumawa ng letter of intent to close at addressed mo po ito sa Revenue District Officer.

Mayroon pong Taxpayer Assistance Counter sa RDO offices ng BIR na maaring makatulong sa inyo ukol dito.

Hi. I’ve read in one of your responses, that the “digitized” pvc-type TIN card… has long been discontinued. Now here are my questions: 1) When was it officially discontinued? 2) Why is it that some establishments (e.g. banks) are still looking for the new digitized TIN card? 3) Didn’t BIR made any official announcement for establishments to honor the TIN card made of cardboard? Can’t really say when it was discontinued. I was in a different division then. And I never got a copy of the announcement when it was officially discontinued.

Second, I cannot really speak for the policies required by establishments or banks. They can best answer this themselves. In my opinion, they probably think the PVC type of card is more believable.

No, the BIR has never made such an announcement that I know of. Mainly because the TIN Card was never made for the purpose of Identification. It is just a confirmation that the BIR has given the card holder a TIN number under his name.

Like you, I would have preferred that our government would grant the BIR the budget to push with a project that would make the TIN card a valid identification card. I know that a lot people are using it as so but only to be turned down because TIN card still lacks security features which would make it a valid identification card.

Unlike the drivers license where it is required that your picture to be taken and is renewed yearly. The BIR TIN card does not contain our picture. Nor does BIR require’s the owner of the TIN to submit his/her pic.

Hi Charlhen,

I am a bit puzzled as to why you could mistakenly register as a professional. The eREG page says clearly that:

“After securing the TIN, Single proprietors and Professionals are required to pay the Registration Fee (RF) of P500.00 thru Authorized Agent Banks (AABs) located within the RDO indicated on the email notification or thru the following BIR-accredited payment facilities”

So it is not really surprising that they will require you to pay the 500 pesos.

Technically they may be unable to process a request for cancellation probably because your registration has not yet gone thru the final process yet.

If you needed a TIN to open a bank account or for employment you should not have gone thru that process as it clearly says you need to pay 500 as a professional in the first place.

In BIR’s terms a Professional is a SELF EMPLOYED INDIVIDUAL. Not an EMPLOYEE.

Anyway, you may need to call the BIR Contact Center for assistance regarding this. As they have access also in this system.

I will try to contact the BIR in Bacoor Cavite tomorrow or their Regional office. To see if what can be done with this type of problem.

As a FREELANCER you are not EMPLOYED. The term implies it.

If you are an EMPLOYEE, then your employer should give you a BIR form 2316 certificate at the end of a taxable year. This usually serves as the ITR of an employee if he has only one employer for the entire taxable year.

The 2316 certificate is certified by the EMPLOYER not the BIR.

If you are a FREELANCER hence your SELF EMPLOYED. It will be you who will filing your ITR with the BIR.

Good morning,

I was requested to get my RDO code, already emailed BIR but they are not replying. Ive searched in the BIR website the RDO codes, but this is my question. Does RDO code pertains to my very first employer? Or to my previous employer? Im employed at my first job at Paranaque, then my second job is at Tomas Morato cor A. Roces in QC. I was requested by my third employer to get my RDO code, with this information in place, what will be my current RDO code??

Hi!

I am working right now in a call center company and my current employer is asking me for a form 2316. The thing here is that i was just a free lance cartoonist in an animation studio for a year and they didnt require me of my TIN. I was also previously employed by a call center company and stayed there for almost two years (2006-2008) prior from being a free lance cartoonist. My question is, will it still possible that i can get a form 2316 from my previous call center employer even if they are now under a new management?

What email address of BIR did you use?

No, RDO code does not pertain to any particular employer you were with.

You can check the RDO code or number where your TIN is currently registered thru the TIN Verification ofc or the BIRCC. Their numbers is indicated in the article above.

You will provide them with your full name, and birthdate or if you know your TIN you can also give it to make the search much faster. Ask your RDO number or code.

RDO code or number pertains to a particular BIR Revenue District Office (RDO). for example RDO 40 is the BIR ofc handling Cubao area. RDO 45-Marikina handles the Marikina, Antipolo and Montalban area. RDO 39 - South QC handles the southern portion of Quezon City.

Just call the TIN verification ofc so that you will know which BIR RDO your TIN is currently registered.

Hi Ran,

The 2316 that your current employer is asking is most probably for the current months of 2010 taxable year.

For example you were just employed with that current company this month of August. The 2316 certificate they are asking is the 2316 covering months of January 2010 to July 2010.

For your info. Whether you have a TIN or not. Employers or Companies are required to withhold tax from the compensation of their employees. So if an employee has no TIN yet they should secure one under their name.

For your 2316 for the years 2006-2008 should be possible to get. Since companies are required to keep their records for at least 5 years. The term under new management do you mean new owners of the company? Those records should still be there. The books, journals and business documents should still be with them.

Yes it is possible to get your 2316 certificate if your previous company has been religious filing with the BIR and complies with keeping of business documents and records.

Hmm, freelance cartoonist? interesting field. If you decide to practice your profession as SELF EMPLOYED PROFESSIONAL where you can actually dispense your own ORs let me know. Thanks for replying. What I mean is if the RDO code represents the disctrict office of my very first employer or my previous employer? Im a liitle bit confused, some says its the RDO of my first employer, some says its the previous employer before your new employer. I cant call them for now because of the long distance fee. ^_^. I’ve emailed them at contact_us@cctr.bir.gov.ph two times already but no reply was sent to me.

Hi,

I’m a self-employed illustrator and currently in the process of registering a business to get a TIN. My business is very small and I have no employees.

I also don’t have a monthly income as my work is usually on a per contract basis. For example, I only get paid once but the contract work can take 2-3 months to finish.

What kind of BIR forms should I fill up? Also, will I be obliged to pay ITR every month or is it only required at the end of taxable year.

Hi Eugene, Your employer like you has TIN. Usually if you don’t a TIN yet the employer would likely ask you to apply for one with the RDO where they file their taxes. So the Employer’s and its employees should have the same BIR Revenue District Office where their TIN is registered.

I can understand that some would say your should apply for TIN with the RDO of your first employer.

Anyway, the RDO where you first applied for your TIN can be easily determined thru the TIN Verification ofc or the BIR Contact Center. The numbers of these offices are provided in this article.

You can apply for your TIN Card from Monday to Friday 8-5PM.

Yes, if you know the RDO where your first employer applied for your TIN you can go that office.

But I suggest to call first the numbers mentioned for verifying TIN and where it is currently registered. There times i have often heard of people thinking they were applied by their employer only to find out later when they check with the RDO they thought they had a TIN but found out that they don’t have a TIN registered yet under their name.

This is why I would suggest to call the TIN Verification office to be sure.

Kung gaano katagal po ang processing naka depende po ito talaga sa workload ng RDO ninyo. But most probably it will take 3 days. HOpe this info helps you out. Good day.

I cannot really say what taxes that you would be required to file and pay.

But since you do not have employees, there’s no withholding tax that you need to file. This is usually taken from employees of an employer.

If you are classified as a Non Vat Taxpayer which i believe will be your classification. VAT Taxpayers are those who have a gross annual income of 1.5M and above. So if you don’t fall within this threshold you will be classified as a VAT.

I suggest you visit the BIR Revenue District Office and allow our officers to evaluate your business. The Annual registration is 500 pesos upon registration.

Once you get your Certificate of Registration you can apply for an Authority to Print Receipts. If you have a client that needs an OR you can buy a OR booklet with 50 leaves you can temporarily use. It cost around 50 pesos i believe. If have any other concerns. pleas post it here.

Anyway, I will ask more on your profession. I want to ask do you have a PRC card? Or is your profession required to have a license like engineers, doctors or lawyers?

My work does not require any license. I’m not employed and drawing is just my hobby but there are people who would sometimes hire me to draw for them.

When I applied for a TIN, the BIR personnel told me to apply for a business permit first but I’m afraid that I don’t have a steady monthly income to pay a monthly return.

Also most of my clients are abroad so I don’t know how to invoice them.

Thanks for the info on your profession.

Yes, the SOP would be to require you to register for a business permit. If you intend to pursue this line as your business.

But this is not a regular activity or if you have no intention to pursue this business. It may be impractical to register it. Because if there is no takers or job contracts you may well decide to stop operating. Which is usually the case of some people only to find out that they have open cases because they stopped filing thinking that if there is no business activity to record or file. They can just leave it at that.

Unfortunately, this should not be. Whether you have or don’t have any business activity. You are still mandated to file. To inform BIR that on this particular month you have no business coming in to your company.

As long as your business is registered with the BIR and you have not filed a formal letter of intent to close the business and officially receive the Certificate of Closure from BIR. In BIR’s eyes, your business is still open and running.

So if you don’t file for a particular month, a computer program which monitors business compliance will report an open case on your business. Meaning you have not filed or remit taxes on your business operation.

Another info you may need to know. Any income coming from abroad not within the Philippines is not taxable. Like OFWs who are earning from companies abroad are not required to file or pay taxes on the compensation they received.

So if you intend to pursue your business here. And you get job contracts within the Philippines. You may want to register your business. So you can issue your own ORs. Anyway, should you have any other concerns please post it here. Good day.

Hi Karol,

We are under the substituted filing policy of the BIR. The BIR form 2316 which serves as the ITR of an employee is attested by the employer not the BIR.

These 2316 certificates are not kept by the BIR mainly because we do not have the facility to keep these documents.

This is why the BIR made this policy. Wherein the employers are required to keep the records of their employees since they are the ones who are withholding tax from the compensation of their employees. Under this policy they are also required to give their employees these certificates.

Thus, it is within their capacity to give and grant request of another copy due to loss of said certificate.

So you should request this from your employer, else you can file a complaint with the RDO who has jurisdiction over your employer. I am puzzled as to why they should not grant your request.

Actually, you should direct your request to the Accounting department of your office for they are the ones who are keeping and filing taxes of any office. Unless of course that function is under the HR also. which i believe is unlikely.

Ok, let me clarify somethings on business derive from abroad.

I was informed that your business is like exporting, w/ is illustration services. Your transaction with companies or individuals abroad would be treated as zero VAT. So the transactions abroad is not subject to VAT.

But your INCOME is still subject to tax since you are residing here in the Philippines. Unlike an OFW where they are actually rendering their service on foreign soil. They are exempted in filing Income Tax Returns under out laws.

Anyway, you can request for an orientation on how to file and what you should file once you intend to operate this business.

The form you will need is the BIR Form 1901. You can see a copy of this thru a link "BIR Forms" on the left side of this blog. Do check it out to familiarize yourself on the said form.

The usual requirements for this is PRC license for your PROFESSION. But since your profession does not require a license yet. So you will need is a DTI permit. So you may need to register your trade name. Visit www.dti.gov.ph.

I was informed that a business permit was not required for PROFESSIONAL. Probably because they use their home as their office and not a regular office in a commercial area.

So once you have the requirements. Have a photocopy of your birth cert. or marriage cert ready. And you will be ask to pay a annual registration fee of 500 pesos. Again once you submit your registration. Be sure to ask when they can release your COR or Certificate Of Registration.

Once know when, and you finally got that COR. And again ask for a schedule on an orientation for what tax you are required to file and pay and when you need to file it. To AVOID penalties.

Do get the contact numbers of your RDO (Revenue District Office)

Once you have your COR, you can now apply for an authority to print receipts. Ask for the accredited printers of your RDO. So you can print your ORs. I'm sure not all your transactions will be coming from abroad. You don't have to limit your business.

If you have registered ORs, your business is legit and can market it to companies and establishment who may need your type of service. Do you have a blog on your works? it seems interesting. Anyway, good luck on your business. Good day.

Found a very informative site, at last.

Hi, there. I’m a freelancer, too, like Jun (up there). We call people who hire us (usually from US and UK) “employers” although only on general terms, not really that formal (they aren’t charging for taxes for tasks outsourced from freelancers outside US and we don’t sign any contracts for health benefits etc.). We just do the task they assign us and after getting paid, the contract ends.

Question is: are we supposed to by charged with taxes? Is it a form of compensation income? I read that the Tax Code says “income from any source” and freelancing for US people creates an income. Plus, are we supposed to submit something to get an ITR? The requirements says that self-employed peeps need to submit a Business Document.

Last Question: Can students avail of TIN even without income? I mean like SSS?

Hi Kristine, thank you for sharing your views on people who requires your services. But I would advise that we should be clear on the terms we use because it may create a bit of confusion.

A FREELANCER is more of a self employed individual. People or company’s who require your services are actually your CLIENTs or CUSTOMERs although they can be referred also as an EMPLOYER. But for the sake of clarity lets just refer to your employer as your CLIENTs.

Are you supposed to be charged with taxes? well, like i said to Amanda just before your post:

“Your transaction with companies or individuals abroad would be treated as zero VAT. So the transactions abroad is not subject to VAT.”

As an added info, Businesses registered in our land are considered withholding agents of the BIR. If you are classified upon registration as a VAT Taxpayer. You are required to impose & withheld a 12% VAT on all your transactions.

Meaning you need to withheld 12% on top of your Service charge. So if you charge 1000 pesos for your service if your registration is a VAT Taxpayer. You will add an additional 12% on top of your Service Fee or charge. So your client should actually pay 1,120 pesos.

The 120 pesos is the tax you will remit to BIR. Please note this is not a TAX on your INCOME yet. it is a Value Added Tax (VAT) it is not an INCOME TAX. This is of course for clients within the Philippines.

But since your client is outside our land. then the transaction is zero vat. meaning you don’t have to impose tax on the said transaction.

You derived an INCOME from your transaction with your clients abroad. Now you did that work within the Philippines that is why this Income is TAXABLE.

Compared to OFWs who earn income abroad but likewise rendered that service on foreign land, that income is NOT TAXABLE.

For filing of your Income Tax Return for Self Employed use the 1701 form. At the back of the form are very useful information. It also has a tax table so you can determine the amount of tax you need to settle with the BIR. It also includes the deadline of filing. Yes, students can avail of TIN depends on the purpose that why they need it. The form that they will use is the BIR form 1904. For example the purpose that you need is for opening a bank account. The TIN issued thru this 1904 is for One Time TIN Transaction (ONETT) only.

The TIN issued to you here is intended for the said purpose. This TIN is marked as a One Time TIN. But it can be updated to the ITS database as regular TIN for business & employment. To update if for employment use 1902 for self employed use BIR form 1901.

The documentary requirements are a barangay clearance, a photocopy of your birth cert. and submit this to the Revenue District Office who has jurisdiction over your barangay. Hi Kristy, under the new law RA 9504 whether single, married or head of the family the personal exemptions would be 50K.

Yes, you can get additional exemptions. The law provides 25K for each DEPENDENT CHILD. Max. of 4 child. Read page 23 letter (I) (1) (b) of the RR 10-2008.

You can update your personal exemption using BIR form 2305 “Certificate of Update of Exemption and of Employer’s and Employee’s Information”

Attached the birth certificate of your child or children. If your husband has already claimed this personal exemption for your family. Your husband needs to execute a waiver.

Read page 25 of the RR 10-2008 number (5) to better understand this. Waiver is executed in cases where the husband is unemployed.

Hi, I just would like to ask some questions/clarifications on what I need to do to get my tin. I actually need a tin for a drivers licence and for future employment. I worked in a call center before for 16 months (my 1st employer), submitted my form 1902 upon employment and was surprised to know last week that I did not have a tin. I went to bir pasig to verify and also wanted to apply for a tin card but the lady told me that i dont have a tin. My employer though provided me w/ the itr or form 2316 at the start of the year but my tin is not indicated on there as well as on my payslip. Im actually wondering if they did pay my taxes. Can I apply for a tin though? and where? I dont have a job yet, and I need one for a drivers license. The bir pasig lady told me to apply in RDO 40 coz I reside in cubao. Will they accomodate me even if Im not yet employed? If so what documents do I need to bring?

Hi Fiona, for your information under the substituted filing policy of the BIR, employers are required to withheld tax from their employees even if they still don’t have a TIN.

A TIN is not the same in character as a Bank Account number. It is a Taxpayer Identification Number registered in our name.

I would like to suggest that you verify thru the BIR TIN verification office or the BIR Contact Center to check if you have a TIN. Just in case if the BIR personnel in Pasig was just unable to locate your name.

If the RDO in Pasig is correct in saying you have no TIN yet. Then you can apply for a TIN using BIR form 1904 attachements are birth cert. and barangay clearance.

Yes, if your barangay is under RDO 40 then you should apply for your TIN in the said office. Its located in the BIR Regional office bldg. in Quezon Avenue corner Sct. Santiago sts. near Delta Theater.

TINs issued thru 1904 are under One Time TIN Transaction (ONETT) and it is not yet considered as a regular TIN for employment so you may need to updated it once you get another job.

hi,

i was just recently married. yesterday, i went to dumaguete’s BIR office to file BIR form 2305 and update my civil status. i was surprised that i was told by the clerk that my tin was not registered in RDO 079 (dumaguete) but was registered in RDO 036 (Puerto Princesa, Palawan). You see, sir, I applied online for a TIN before I got my first job at a call center here in dumaguete city; that was way back november 2006. i put in there Puerto Princesa as my RDO since I do not intend to work for a long period here in dumaguete at that time and I planned to go back to my home town (puerto princesa) after several months. Things did not turn out as a planned and I stayed in dumaguete and got married. . . now, i got thru the online application, but the HR of our company said that the online process is not valid and that our company will process my TIN for me. After several months of work, I was surprised that the TIN that they gave me is the same as the one that I got when I made my application online. . . and now i am really surprised that that TIN is still registered in Puerto Princesa and that BIR dumaguete would not approve tax exemption update unless I transfer from RDO 036 to 079….

Hi Ayan, anyway congrats, well first off your company may have access but once the registration system detects that you have TIN already they cannot do anything with that but to inform you on what they got.

And that is the TIN you got when you applied online. We can only have one TIN. You maybe penalized for having more than one TIN.

Yes, BIR Dumaguete cannot actually process any application for update on your TIN registration because your TIN is not yet with them but with the BIR in Puerto Princesa RDO 36 where you first opted your TIN to be in.

hi, may i inquire how to get a TIN ID. I just recently got my TIN at RDO-40 (Cubao) thru EO-98 last august 2010 when i applied for a student’s driver license, at that time i was and still am unemployed. At RDO-40, they just wrote a number on my application form and returned it back to me. So I asked the personnel if the number they wrote was already my TIN and said yes. My 1st question is: am i already registered? or do i need to be employed muna before my TIN can be activated? Now that i’m applying for a job locally, the company i’m applying for asks me to submit a xerox copy of my TIN ID, which I don’t have yet. My 2nd question is: can i apply for a TIN ID even if i’m under EO-98? if so, how much are fees and time required to get my ID? I used to be employed in a clinic for 2 years and asked why they cannot provide me a TIN, and said they just can’t! and can’t even fill-up my application form before, but they deduct taxes in my salary. I’ve read your website, and also called your BIR office, and say it should be the employer who should process his employees’ TIN. While reading this site (which i found very informative), it’s only you who categorically said that that the employee may process his TIN if the employer can’t. Should I have known that, and should BIR put that info into their site, sana I am paying my taxes na as a good citizen of this country should do. So my 3rd question is: since i just got my TIN last aug 2010, is my tax collection retroactive (i.e. included ang last 2 years of employment ko na di ako nagbayad)?? if so, what could be my penalties? sana naman included yung mga ganitong queries and problems to the FAQ’s ng BIR website. another question: will my last employer be sanctioned for not processing and filing his employee’s TIN and taxes? I understand some of my co-employees TIN were acquired from their respective previous employers, while kaming baguhan pa noon wala pa. Lahat kaming employees nya nadededuct-an ng tax sa sweldo pero not officially written in our pay-slip kasi ang explanation ng employer if sila magpaprocess ng tax namin bababa ang sweldo. OK lang saken kasi mababawasan naman talga salary from tax deductions, pero sa mga kasamahan ko they just passively let things happen wag lang bumaba sweldo. I heard nag-file ng complaint ang mga kasamahan ko 3 or 4 years ago pero wala namang reply ang BIR. Please enlightened us regarding such matters. I personally will be happy if my previous employer will be sanctioned. Panu na lang kaya if lahat ng employers ganito, hassle na nga sa trabaho and employees, hassle pa sa pagproseso ng kanya-kanyang tax. thank you again po.

Yes, you have a TIN registered under your name. But know that this TIN was issued and mark as One Time TIN made possible thru EO 98.

Meaning it was issued to you for the purpose of transacting with a government office like the LTO. it is actually active in the BIRs database but is marked as a One Time TIN. BUt you can update it to a regular TIN using 1902 should you find an employer.

Yes I believe you can still apply for a TIN card for the particular TIN which you got thru 1904. There are no fees for that request.

But since you mentioned that you already have an employer. I would suggest that you fill out the 1902 form. In that form there is a portion for your Employer to Fill out. On the top of that form is portion where you need to fill your TIN no.

This would indicate or if your employer is unaware regarding this procedure. That you have a valid TIN registered under our name but it is still marked again as i said a One Time TIN which you just have to mention to your employer.

That the BIR will no longer issue you a new TIN because you already have one. it just needs to be updated. Once you and your employer fills out the 1902 and submit to the BIR office holding that TIN registration.

With regards to your observation regarding the BIR office informing you that it should be the employer who should request for your TIN came from I believe a ruling. The BIR has already launch the eREG for employers to be able to access this and request online for the TIN of their employees.

Unfortunately, not all offices can comply for reasons probably lack the personnel to run this task. It has put a problem for an employee requesting for a TIN when his or her employer could not yet do for them. And the BIR personnel would refuse to process a TIN application and direct them to their employer.

Anyway, you can request thru the Chief of the Taxpayer Service Section should the frontline personnel insist on your employer to do it for you.

Just tell them about your employers limitations. if the employer is indeed REQUIRED then they should call your employer or warn of SANCTIONs that will be imposed for your employers inability to comply.

Anyway, this is under the Handang Maglingkod Program of the BIR to assist Taxpayers and provide solutions. Do inform us if the BIR personnel was unable to assist or insist on having your employer comply.

As an employee you can mention it to your employer but you may not be able to make them comply. This should be the BIRs job to do it for you. Do inform us if the problem persist. Actually, we haven't heard of this problem yet with other RDOs. We will communicate with the concerned offices regarding this matter.

Anyway, the implications pertaining to taxes withheld by employers should not affect us unless the employer refuses to issue our BIR form 2316 certificate on the Withholding Tax they withheld from our pay.

If you gone thru some of my reply's the TIN is not the same in character as a bank account. Thats why even if an employee has no TIN the employer are still required to withheld tax from their employees.

If your previous employer withheld tax but refused to give you the 2316 certificate at the end of each taxable year. Then probably that employer did not remit your tax to the BIR.

No, You cannot be penalized for that. It would be your previous employer who is the responsible party on remitting taxes for their employers to the BIR.

If you file a complaint against your employer to inform the BIR regarding this. Then that would be the time the BIR may act or investigate this allegation.

I cannot really comment on the complaint filed by this person you mentioned. If they have a received copy and the name who accepted that complaint then we can inquire about it.

One of the problem I think lies on BIR personnel being transferred and the documents under him or her were not properly turned over. This is why your BIR thru our Commissioner is working on the computerization of certain BIR processes.

We are thankful for your concern and vigilance. It is thru your support that we get these information which we relay to the concerned offices. Anyway, we should not be disheartened if the wheels of justice seems slow.

You may be interested to know that a lot of establishments have been penalized by the BIR due to varied offenses. The small ones doesn't usually get that much publicity or attention compared to large establishments.

Ang employer po natin ang dapat mag issue ng BIR cert. 2316. At kung isa lang po ang employer ninyo for an entire taxable year. Yung 2316 ay nagsisilbing ITR na ng empleyado. At para sa inyong kaalaman po ang EMPLOYER po ang nag-aattest sa certificate na ito hindi po BIR.

hi, How can I know that my tin issued to me is correct since when I check it on the internet it shows that I dont have one. I already ask some bir personnel if I have an existing tin but they said I dont have, but my employer recently gave a no.,how can I know if yhey gave a correct TIN?thank you so much.

Hi Annie, I don’t know about checking of the TIN in the internet. But anyway, did you call the TIN verification office of the BIR or the BIR Contact Center to verify if you do have TIN?

You mentioned that you have a TIN. So give that information to the TIN verification office so they can verify if that TIN is valid and under your name.

Hi Annie, that TIN is recorded in the BIR database as OLD. It was registered in RDO 47 but when the TIN is inactive or was not updated, it fell on that category. Is your surname Aguro? if it is then this TIN is most probably yours.

Ok, thats settled you have an existing TIN. You just need to register it to the RDO where your current employer is under.

To have your TIN updated from OLD to the ITS database, use the 1902 form. Do write your TIN in the provided portion of that form so that the one who will process it will not mistake that you need a TIN.

So fill out the portion provided for you and sign. For the Employer Information portion of that form. Let your employer’s authorized representative fill that our and have it signed before submitting that form to the RDO who has jurisdiction over the business address of your employer.

That’s it BIR will process and updated your TIN to included in the ITS database. Should you have any other concerns just it here. Good day.

Hi, I just want to know if how can i get a copy of my itr?without asking it from my previous employer. can i get a copy from BIR office? i am employed from that company for almost 3 years and nag-awol po ako for some reason.And now my new employer required me to submit itr from my previous employer.Thats the only hindrance why i will not be able to start in my new job.. i really need your help and guide.ASAp i will really appreciate it. thanks and godbless

Hi Babybelle, I regret to inform you that the BIR does not keep copies of the 2316 certificate issued by employers to their employees.

The BIR does not require EMPLOYERs to furnish them the copies of 2316 they issued to their employees.

This is why under substituted filing policy of the BIR. It is the EMPLOYERs who keeps their employee's records thus they are the ones required to issue the 2316 certificate and attest to the accuracy of the information under penalties of perjury.

The only time the BIR retains a copy of it is when an employee has more than one EMPLOYER for a particular taxable year.

And it is submitted or filed by the EMPLOYEEs to the BIR and NOT the EMPLOYER. Please take note it is FILED by the EMPLOYEE’s and NOT the EMPLOYER to the BIR.

If you cannot request this personally you may opt to do it in writing. If your previous office refuses to give you this certificate.

You have the option to file a formal complaint with the Revenue District Office of the BIR having jurisdiction of the business address of your previous employer. Good day.

Why is it that BIR San Juan makes it difficult for persons to acquire a TIN? The form specifically states that a driver’s license or a passport is sufficient as an attachment but the lady simply refuses to process our applications and insists that only birth certificates are allowed. Since I have to order the birth certificates from the NSO, will my company be penalized for late registration of my employees since I read somewhere that I had to inform the BIR within 10 days of employment?

If I decide to rent out my condominium unit, can I simply record it as income in my annual tax return or do I have to register with DTI? If I do have to register with DTI, do I need to get a mayor’s permit and all the necessary permits before I can register with BIR? It is too much paperwork for a 5000 peso rental income.

Alam ko po na hindi related itong concern ko dito sa forum na ito, pero nais ko lang pong mag-vent out dito tungkol sa pangit na serbisyo ng inyong kawani…
kanina po galing ako sa BIR dumaguete. iuupdate ko po sana ang TIN ko para ma-instransfer from my old RDO (puerto princesa) to dumaguete.
maaga pa po ako dumating sa opisina ng BIR dumaguete, 9 sharp po nandoon na ako. Hindi po mahandle ng clerk sa counter ang concern ko at inerefer ako sa isa ninyong kawani na me access daw sa mga TIN (let’s refer to her as BIR employee A). Sabi nitong si employee A eh wala daw sya access sa server para ma look up ang TIN ko at ma-process ang transfer.. sabi nitong si A eh yung isa nyang kasama (let’s refer to her as BIR employee B) lang ang merong access sa mga TIN. Nagkataong po intong sa employee B ay meron pang hinahandle na nagpapaupdate ng TIN…matagal ang trasanction kay B at eto namang si A ay walang hinanadle at sitting pretty lang… lumipas ang 30 minutos at tinanong ako nitong si A kung ano ba ang concern ko at sinabi ko sa kanya na mag-tratransfer ako ng RDO. tiningnyan nya yung form 1905 na dala ko–at yun, me access pala sya sa database ng mga TIN!!!!
naniniwala po ako na hindi lahat ng kawani ng BIR ay nagtatad-tamaran at walang pakialam sa mga ordinaryong taong katulad ko….
ang mga katulad ni BIR employee A ang nagbibigay ng masamang pangalan sa ahensya ninyo.
meron po ba kayong email address or any channel na pwedeng ireklamo ang mga ganitong klaseng empleyado?

Salamat Ryan at ibinahagi ninyo ang iyong karanasan. At nakakalungkot man pero meron talagang mga ganitong tao. At kinakailangan natin ipaalam sa mga opisyal ng BIR ukol maling karakter sa isang kawani ng gobyerno.

Pumunta po kayo sa BIR Web site nasa left ng site na ito scroll down po at hanapin ang eComplaint icon. click ninyo ito at pupunta kayo sa sa page upang ipaalam ang sa BIR ukol sa mga empleyado na hindi maganda ang pagdadala ng kaniyang tungkulin. Under po ito ng Internal Security Division. Maari rin ninyo email ang Revenue District Officer ng RDO ng Dumaguete at ang Regional Director.

Bagamat sa ngayon di ko pa alam ang address nila. Maari kayong mag-email sa BIR Contact Center contact_us@cctr.bir.gov.ph upang iparating ang inyong reklamo sa prebadong mga opisina para ma disiplina nila ang kanilang mga tao. I-request mo nalang na forward ito sa RDO ng dumaguete at Regional Director ng area na iyon. Magpadala rin kayo sa tied@bir.gov.ph. Under ito ng Taxpayer Information & Education Division ng National Office ng BIR. Maari rin nilang i-forward ito sa nasabing mga opisina.

Salamat po muli po. Ang mga ganitong mga information ay makakatulong para ma improve serbisyo ng BIR.

Yes, I believe so especially if your clients requires an OR. DTI permit and business permit. This was what my uncle did on his unit near Ateneo.

Magtatanong lang po.
Mag-a-apply po kasi ako ng student permit. Eh kailangan raw po ng TIN, student pa lang po ako. Sa nabasa ko po ang kailangan ko raw po eh yung TIN (registering under eo98). Ngayon nakita ko po na may online service ang BIR kung saan pwedeng mag-apply ng TIN ngunit may nakasulat po sa site na: “Prospective EO 98 taxpayers may secure their TINs through authorized Government Agencies and Instrumentalities (GAIs). GAI authorized users may logon to the eTIN by clicking on the Authorized User Login at the left side of the screen. ” Saan po ako makakacontact ng GAI? Paano po ang magiging proseso nitong online na pag-a-apply? (Mas nais ko na lang po kasing mag-apply na lang online dahil mas convenient po ito para sa’kin. Kung sakali lang naman pong pupuwede)
Kung sakaling ‘di po ako makakuha ng TIN gamit nung online service at mapaagdesisyunan ko pong pumunta na lang ng BIR, saang BIR po ba dapat mag-apply? Taga-Imus,Cavite po ako. Mayroon daw pong district office sa Bacoor, doon po ba? O pupuwede po bang sa Maynila na lang po ako mag-apply? (dahil mas madalas naman po ako doon.)

hi. i’m about to start working for a new company and they are asking me to fill up form 1905. the HR said i need to GO to my previous employer’s rdo to fill up section 4E (transfer of home rdo). do i really need to personally go there? can’t i just call them and ask for the rdo code?

also, i noticed that there is a part in 4E that says “MUNICIPALITY CODE (To be filled up by the BIR)”. this refers to the municipality code of the NEW address to which my tin would be transferred, right? do i also need to personally go to the rdo to which it belongs so the BIR can fill up that part?

Ang GAIs tumutukoy sa Government Agencies and Instrumentalities na nakakuha ng access sa eTIN registration. Tulad ng LTO kung saan nagnanais kayong kumuha ng Student Permit.

Kaya lang may balita ako na may bayad ito. Mas mabuti na kumuha nalang kayo ng TIN using BIR Form 1904 sa BIR Revenue District Office (RDO) na may hawak sa inyong barangay. Attachment po nito ay photo copy ng Birth Cert. at Barangay Clearance.

Para malaman ninyo kung sino nakakasakop sa inyong barangay na RDO. Tawag nalang po sa BIRCC. Itanong ninyo kung sinong RDO nakakasakop sa inyong barangay. At kung nalaman na ninyo ay dun po kayo tutungo.

Dalhin lang ang mga attachments na binangit ko. pagdating sa RDO kumuha ng BIR Form 1904. Fill up mo ito at attach mo nasabing mga dokumento. Bibigyan ka nila ng TIN under EO98.

Libre po ito. So mas tipid po kung kukuha kayo sa RDO ninyo.

Subukan ninyong tawagan nalang ang opisina ng Bacoor. click ninyo ang link sa directory ng BIR sa ibaba:

Kung nasasakop ng Bacoor ang barangay ninyo, ay dun po kayo pupunta. Hindi po pupuwede kahit saan nalang kyo mag-aaply dahil may nakakasakop po sa inyong barangay ng RDO. Na kung saan sila po ang may jurisdiction sa area ninyo.

kapag nakakuha na kayo ng TIN thru EO 98. Itong TIN ay under ONE TIME TIN category. At kapag nakapagtrabaho na kayo. Ito pa rin ang TIN na gagamitin ninyo.

Ipapa-update lang ninyo ito sa pamamagitan ng BIR form 1902. Kung ang TIN ninyo ay nakuha ninyo sa RDO ng Bacoor halimbawa. at naka kuha kayo ng trabaho sa Cubao area na hawak ng RDO 40.

Ay dapat muna ninyo ipa transfer ang TIN ninyo from BAcoor to RDO 40 na may hawak ng Cubao. using 1905. Paki basa nalang ang article ko ukol dito.

At ang BIR form 1905 ay sinasubmit po sa RDO kung saan ninyo nakuha ang TIN ninyo. sila ang may karapatan mag transfer sa RDO na may hawak ng business address na pagtratrabahuhan mo.

Once na transfer na po ang TIN ninyo dun sa RDO na hawak ang business address na kung saan kayo magtratrabaho. Puwede na ninyo ngayon ipa UPDATE ang TIN ninyo into a REGULAR TIN. Dahil classified na ito na ONE TIME TIN sa database ng BIR. So dapat po ninyo ipa update thru BIR form 1902 na kung saan ilalagay ninyo ang detalye ninyo at ang TIN na binigay sa inyo. At may portion din po ang EMPLOYER ninyo kung saan kelangan nilang fill-up din.

Bago ninyo submit ngayon sa bago ninyo RDO. Ang RDO na pinaglipatan ng TIN mo. Tandaan ninyo lang na hindi sumusunod ang TIN ninyo kung lilipat kayo uli ng trabaho sa lugar na hindi na sakop ng kasalukuyan mong RDO. Kelangan ninyo request to transfer kapag dumating uli ang pagkakataon na ito.

Hi Amanda, to know your RDO code just call the BIRCC or the TIN Verification Office. Their numbers are indicated in this article.

To file the BIR form 1905, it should be filed to the old RDO or the RDO where your TIN is currently under.

You just need to fill out the RDO code. The BIR RDO which currently holds your TIN will fill that out. So you don’t need to worry about this.

So get the RDO code of your TIN and the RDO code of your new employer. Or the RDO where your employer is currently filing their taxes.

Carmen, if your intending to get a job. The requirements of the BIR is that application for TIN for employment starts when you find an employer first. Because this is where we would know which Revenue District Office (RDO) who would process your application for TIN.

Which really depends on the business address of your future employer. The BIR has an RDO who handles a specific area.

Now if this is not your intention please indicate clearly what future requirements are you referring to?

It is possible to get a TIN for securing a drivers license or opening a bank account. But the TIN would be categorized as a ONE TIME TIN in the BIRs database.

Meaning it is not yet a REGULAR TIN. If you intend to work you will still need to update this type of TIN.

Hi Lourdes Nastor,

An ITR is our Income Tax Return. It is not the BIR who files this or fills this form out but it is we the taxpayers who are required to do this.

We do it because it is required in our Tax Code. We declare the income we accumulated for the entire year. And of course there is a tax imposed on our Income.

This is called Income Tax.

If you honestly believe that you do not have any income for the entire year. Then you may declare it and file your ITR with the BIR indicating this. So if you have no income then there is no tax yet to pay.

Our ITR is filed at the end of the taxable year. Deadline is usually April 15th of the following year. So for the year 2010 when it ends. The ITR filing for the taxable year 2010 is on or before April 15th 2011.

And if this is so, I am wondering how you can apply with pag-ibig. Or pay the monthly pag-ibig dues if you do not have any income yet. Anyway, hope this info helps you out. Should you have any other concerns just post it here or visit my other blog www.tomtax.blogspot.com. Good day.

Hi gha, Yes you can use your TIN. You don’t need to apply for another one. Having multiple TINs is not allowed.

Hi Louie, if you have a business in Malabon and still active. the RDO in Malabon will not allow that transfer as you have a registered business in the said area.

Just inform your office about your business. So you don;’t need to transfer your TIN.

Hi Angelo, any transfer of TIN is done and requested by the owner of said TIN. No one can do that except the owner of said TIN. 1905 form is used for this request.

And if you look behind the said form. It is the TIN owner who should sign not the employers.

Some employers could do it for their employees. I cannot really answer for your employer. You should ask them.

pano po yun nagkawork po ako ng 2004 then ung 1st employer yung kumuha ng tin ko then my next employer di naman po nagrequest ng 1905 nung ganun din yung 3rd employer ko. both of them just ask for the 2316 as their requirements but now with my 4th employer dito lang po ako naka-experience na 1 of the requirements is 1905. ngaun po pano po yung contributions ko from my 2nd and 3rd employer? panu ko malalaman kung talagang nagremit sila? thanks po.

Hi Angelo, ang tax o buwis ay hindi contribution. Hindi po ito tulad sa SSS or GSIS or bangko po na maari ninyong ma withdraw ang na deposito ninyo. Hindi po gayon ang buwis.

Ang tax po ay ibinabayad at ni-reremit sa ating gobyeno. Para magamit sa serbisyo ng publiko.

Hindi ko po masasagot ang patakaran at pagpapatupad ng mga employer ninyo. Sila ang pinaka mabuting sumagot dun.

Ang TIN po ninyo ay naka rehistro sa isang RDO na may hawak sa business address ng inyong employer. kapag lumipat ka sa ibang employer na hindi na sakop ng kasalukuyan mong RDO. Hindi po automatic na sumusunod yun TIN ninyo kung saan po kayo lilipat.

Kaya po kinakailangan pong ilipat ninyo sa RDO na nakakasakop sa bago ninyong employer. Para po kung sakali may update kayong kinakailangan para sa inyong TIN ay magagawa po yun ng RDO na may hawak sa business address ng bago mong employer.

Ngayon po sa tanong ninyo ukol sa tax na na remit ng mga dati ninyong employer. Nalalaman po natin na naibigay ito sa BIR sa pamamagitan ng BIR 2316 certificate na ang employer ninyo ang pumipirma at nagpapatototoo ukol sa pag remit nila ng tax na kinaltas sa inyo.

Wala pong problema kung saan na remit ng employer ninyo nun dahil ang TIN po naman ay hindi tulad ng Account Number or SSS number. Kahit po wala kayong TIN under substituted filing na kasi tayo. Required ang employer na magkaltas ng kaukulang buwis sa ating sahod para mai-remit ito buwan buwan sa BIR RDO nila.

At batay din po sa policy na ito. Required din pong magbigay ang employer ng BIR 2316 certificate bilang patunay sa mga kinaltas nila sa kanilang mga empleyado. ito ay binigay pagkataspos ng isang taxable year o kung nagresign na ang isang empleyado.

Dapat pong kunin ng isang empleyado ang kanyang 2316 sa dati niyang employer pagkat ito po ay hinahanap din ng bagong employer.

Hindi po puwede sa main office o head office ng BIR ipasa ang 1905. Tulad ng sinasabi ng article sa itaas. Dun lang po ninyo dapat ipasa sa RDO kung saan kasalukuyan nakaregister ang inyong TIN. Kaya kung sa RDO 57 nakarehistro ang inyong TIN dun ninyo ipasa ang request ninyo for transfer.

Wala na pong ibang office ang makakagawa nito kungdi ang nasabing RDO. May registration section po ang mga RDO o Taxpayer Assistance Counter. maari po kayong umugnay sa kanila para sa pag process ng inyong request for transfer using 1905.

Kung may iba pa kayong katanungan. post lang po dito. Salamat din po sa pagdalaw ninyo sa site na ito.

thank you po sa information. nakatulong po ang inyong pagtugon. sana po ay makagawa ang BIR ng isang sistema na kung saan eh pwde po kahit sa Main office or kahit san RDO na pwde magpatransfer or magpastamp ng 1905. kasi yung iba naman na katulad ko na employer na ang kumukuha ng TIN eh minsan nasa head office kami na-assign yun pala yung registered company address eh nasa probinsya.

Hi po, first of all thank you for being so nice as to answer all our questions in your blog/site. This is very helpful to people like me who have little/zero knowledge on taxes & stuff that involves it. I hope that you would also find time in answering my questions.
I have worked with my previous employer for the past 3 almost 4 years. For the first 2 years, our employer issued an ITR w/o the BIR seal/received stamp. Are those ITR or form 2316 legal/valid even w/o the seal? how will I know if they are remitting my tax to the BIR? & if ever I verify that they had been withholding tax from my income but they aren’t remitting it to the BIR, what should I do to get my money back or have them face perjury for that matter?

Second, I recently resigned from that company & is w/ a new employer now, the problem is our HR requires me to get an ITR or form 2316 from my former employer. The problem is, my previous employer has not issued my form 2316 since last year & I doubt if he would also give me a copy now especially since I am separated fromtheir company since my maternity leave last October. My question is, what legal action shall I do to obtain a copy of my 2316 form? where will I have to file the case/complain if ever my previous employer does not give me my 2316 form?

Lastly, I am married w/ 2 kids, I want to be able to claim for the tax exemption of our qualified dependents since my husband does not pay taxes. He works as a seaman abroad & he does not have a TIN ID. Is it true that they are exempted from paying taxes? if so what shall I do to be able to claim for the additional exemption? I am aware that he should sign a waiver for that to happen, the problem is he does not have a TIN ID. Does he need to get one first? Thank you so much for bearing w/ all my questions. Hi Marie Caminong, the 2316 is a Certificate that should be issued to the employees. The Employer is the one who is attesting to the said certificate not the BIR. Even without the BIR seal or stamp the document is valid as long as the authorized representative of the company is the one signing it.

This is in accordance with the substituted filing policy of the BIR. If an employee has only one employer for an entire taxable year. The 2316 that is issued by the employer after the taxable year is a valid ITR even without the BIR stamp on it.

Again taxes are paid to our government. It is not like our money is deposited in bank. No, that would be incorrect to assume that.

You should demand first that 2316 certificate from your previous employer before filing a formal complaint with the BIR branch ofc. who has jurisdiction over the business address of the said employer.

Yes, overseas workers are exempted from filing income tax. If your husband indeed has no registration with the BIR and has laid no claim to the said exemptions then you can claim the additional exemptions for your family.

Just use 2305 and attach the birth cert. of your children. If your asked if your husband has laid claim inform them that he is an OFW. You don’t need to concern yourself with your husband’s registration with the BIR or if he has a TIN.

That fact is that he is an OFW, the wife can claim the said additional exemptions.

Hi there this TIN currently bothers me. i had my TIN since last year but the RDO is northern samar, i was never employed there..i just got a TIN in preparation for a possible job since i already graduated…however,just this month i got my first ever job, i was hired in a company in Pasig and i was asked to change the address of my TIN. how do i do that?

Hi Janah, how did you get your TIN? was it thru online? or you pass your application for TIN thru a BIR Branch office or the Revenue District Office.

But if you didnot pass any application with the BIR in Norther Samar. Then I take it that you applied for a TIN online.

When the Online TIN registration was still open. Many committed a lot errors and only to find out that they didnot specify the accurate branch office. And found out later that their TIN was registered in a provincial branch office of the BIR.

You need to request your TIN registration to be transferred to the BIR office handling Pasig area. Take note, that area was divided into to Revenue District Offices (RDO). RDO 43A and RDO 43B. Ask your employer where they file their taxes.

Once you know this. Fill out the BIR Form 1905. Anyway, read this article:

You can fax that application to RDO in northern samar. BIR RDO 85 - Catarman, Norther Samar. If your TIN is indeed registered there. Thats where you should fax your 1905 back to back. There tel/fax number is (055) 500-9095. Ask for the Registration Section. And relay your intention to fax your application.

My advice before you do this would be to check with the TIN Verification ofc. or BIRCC if your TIN is indeed with RDO 85.

Kasi hindi naman talaga ma-aapprove nung bank yung transaction mo dahil wala kang account sa kanila di po ba?

Kaya po natural na hindi po na-approve. So dapat mong ilagay ang tamang bangko upang ma process yung efps payment ninyo.

Salamat din po sa pagdalaw. Kung meron pa kayong ibang katanungan post lang po dito. O maari rin kayong tumawag sa 981-8888. Pa connect kayo sa eFPS team for additional assistance.

i am also a blogger po. i earn from adsense(Google USA) mga 20k a month.Taxable po ba sya ng income tax?if di naman po, ano po form na file ko sa BIR,ITR Form 1701 po ba?kc yung bisnis po sa baba na nabanggit ko,start pa lang this feb.2011.yung sa google na kita ko mag 2 years na po. gusto ko na rin magfile ng ITR para magkacredit card at travel to countries that require visa.so pano po pag walang formal work,just thru ads sa website,pano po form and pag-file ng ITR,may hihingin po ba saking additional documets ang BIR o just the BIR Form 1701?and the payment of course. how will they arrive po sa pagcompute ng tax,if purely from abroad ang earnings?

Hi Venus, Yes, the income you got is taxable since you did it here in the Philippines.

Unlike OFWs who received income working abroad. Their income is exempt from tax.

So for people who earn their living like yours online within our land is taxable. Yes, ang form po na gagamitin pag file is 1701.

To register our profession as a self employed with the BIR. Use BIR form 1901. The documentary requirements are Occupational Tax Receipt (OTR). This is required for people whose profession is not regulated by the PRC like lawyers, doctors, engineers, CPAs etc. For the said individuals the document required for them is the Professional Tax Receipt (PTR).

Other documents needed for 1901 are Birth Certificate, marriage contract (if applicable). Contract or company certification would not apply to your line of profession I believe unless there is a contract with you and Google Adsense. So the OTR would do.

As you can see BIR would need certain documents from your LGU. So the OTR would be coming from the LGU o sa inyong munisipyo.

Kung mapapansin ninyo dun sa 1901 form meron dun mga taxes na required kayong i-file. Ang BIR officer po ang mag checheck sa naturang box portions bahagi ng form na ito. So alamin po ito.

Once registered then. Puwede na kayong magfile ng inyong tax thru 1701. At kung wala pa kayong TIN. SA pamamagitan din ng form ng 1901. Maari kayong bigyan nila ng TIN under your name.

May TIN na po ba kayo?

Computation of your tax on earnings you made purely online or abroad would start with what you will declare with the BIR on how much income you made for taxable year 2010.

From that point, the amount you made you can deduct the personal exemptions given to us by our government thru an RA. Pare pareho na po na 50K ang personal exemptions ng Single, Married at Head of the Family. Ang balance after deducting this would be the taxable income. May tax table po sa likod ng form 1701.

I would suggest you call the Withholding Tax Division to assist you in filling out your 1701. Their numbers are 926-9347 & 926-9351.

regarding my situation above, i am just starting a business and in the process na ang mayor’s permit and BIR(di pa pumapasok ang BIR dito samin,kaya in the process pa ang permit, 1 week ng absent ang BIR samin!province po kami).

So pano po yun? Do I still need to register for occupational tax receipt?bale yung business is starting pa lang this week. Yung ITR ko sana na i-file is for 2010 na income and at that time wala pa po akong business.balak ko kasi next year na magfile na ng ITR na from income from this business plus my online income.

Hi Venus, well if you applied for your business with the BIR then I take it that you already submitted DTI permit and business permit. If that is the case then you won’t need the OTR.

If you want to declare your income which you earned thru blogging then you can do so. The BIR would certainly welcome it you know.

If your newly registered business is not connected with blogging then you this would be your other income on top of your new business which you can declare both at the end of this taxable year.

Now, you said you already registered this business. I would suggest you ask for an orientation with your RDO on what and how you can file your taxes. They regularly give this orientation for new businesses.

The BIR has plans to produce a video on CD for this orientation. But it is still in the works.

Kumusta sir. Naalala mo pa si Mjolnir? Yung anak kong
gustong pumasok sa McCann? May nakakatawang storing
nangyari sa kanya. Nang nangailangan si Jol ng TIN ay
ginawa siyang pingpong ball ng BIR. So isinulat niya
yung BIR experience niya tapos nilagay niya sa
internet. Biglang kumalat. Last time I heard ay nasa
L.A. na

Anyway after 3 days sa internet ay nabasa ni BIR
Commisioner Parayno yung story. Pinadalhan kaagad si
Jol ng TIN card via mail. Ang bilis.

Ang maganda pa nito ay nag-email kay Jol yesterday si
Bart Guingona. Gusto raw nilang gawing play. Tuwang
tuwa si Jol. Sabi ko nga ay ang agang dumating ng 15
minutes of fame niya.

Anyway here’s his original story:

ADVENTURES SA KAWATANAN NG RENTAS INTERNAS

ni Jol Ong

Okay. So natanggap na ako nung November sa NCCA bilang
researcher. Contract employee lang. 3 months. May
Yearbook project kasi sila at kailangan ng extrang
tao.

Okay lang ang bayad, kaso may 10% withholding tax, at
siyempre, dapat may Tax Identification Number (TIN)
ako. Sotinanong ko yung boss ko- “Sir, di po ba yung
employer ang maglalakad ng TIN ng employee?”

Sagot ni bosing- “Di ka kasi regular employee kaya
ikaw ang maglakad ng TIN mo.”

Assurance nung assistant ni bosing- “Okay lang yan,
one-time hassle lang yan.”

Ala ako problema. Sige, ako maglalakad ng TIN ko.
Tutal, ano ba ang > worst case scenario? Mahabang
pila? Red Tape? Naknamsiomai, sanay naman ako sa UP e-
kuhaan ng classcards, pila sa registration, pila sa
graduation, etc. Ako rin naman ang naglalakad ng
registration ng beetle ko, at sa pagrerenew ko ng
lisensya, so okay lang.

Sabi ni bosing, dun daw ako mag-apply ng TIN sa BIR
Main, sa may QC, para mas konti ang pila! . May BIR
din naman sa labas ng Intramuros, walking distance
para sa mga sanay maglakad, pero mas konti raw ang tao
sa Main.

So, sige, nagpaalam ako, isang araw mag-aabsent ako
para lakarin yun. Dun ako sa Main, dahil malapit lang
sa amin, tapos plano ko, dadaanan ko yung ilang
research materials sa UP. Solve!

Pagdating ko sa BIR Main, nagulat nga ako dahil wala
ngang katao-tao. Ni wala akong nakitang pila, maliban
lang dun sa pila sa harap, dahil tsinecheck nung sekyu
yung bag ng mga tao. Nung pagpasok ko, wala pala
silang TIN forms. Wow. Naubusan ng TIN Forms ang BIR
Main. Hanep.

Tinanong ako nung lalaki sa desk kung para saan yung
TIN application ko; sabi ko, para sa work. Tinanong
kung saan ako nagtatrabaho; sabi ko sa Intramuros.

“Dun ka mag-apply sa Intramuros.” sabi nung lalaki.

“Di po ba puwede talaga rito?”

“Hinde, kasi sa Intramuros ka e, sila ang may hawak sa
‘yo.”

Okay lang, although medyo naburat ako sa efficiency
nila. Ibig kong sabihin, wow, Main BIR sila tapos una,
naubusan sila ng TIN Forms, pangalawa, ewan, ang
laki-laki ng saklaw nilang lugar, ang laki-laki ng mga
building nila, tapos hindi nila ako ma-accomodate.

Taragis, e malamang sa kanila rin naman mauuwi yung
records ko kung sa BIR Davao o BIR Batanes ako
mag-apply, dahil tutal, Main sila e, di ba? So ala na
akong magawa, ala rin silang TIN Forms, so useless din
kung magprotesta pa ako dun. So pumunta na lang akong
peyups (U.P.) for official business, for the first
time. Hehehe!

Pagpasok ko sa work, sinubukan kong lakarin yung TIN
application ko sa BIR sa labas ng Intramuros, yung
malapit sa port area. Pag-akyat ko sa taas, hinanapan
ako ng certificate of employment, at baranggay
clearance. At dahil walang nagsabi sa akin na
kailangan ko nun, lalo na yung lalaki sa BIR Main,
wala akong bitbit na requirements.

Pagbalik ko sa opisina, inexplain ko sa bosing namin
yung problema. Nakatingin sa akin yung bosing ko na
parang nawe-weirdohan din at di maintindihan yung
paghihigpit ng BIR. Lintek, sabi nga nung isang
workmate ko, the fact na nag-apply na ako for TIN,
dinedeclare ko na sa gobyerno na puwede na nilang
kupitan, err, kaltasan ang maliit kong suweldo. Ako na
nga ang magbibigay ng pera sa kanila, ako pa ang
hinihigpitan. Tanginang gobyerno yan, kahit kailan
talaga pahirap sa mga tao.

Anyway, pag-aaralan pa raw nila kung mabibigyan nila
ako ng certificate of employment. Yung baranggay
clearance, ako na ang maglalakad. Plano kong bumalik
ulit sa BIR Main. Hindi ko na lang sasabihin na sa
Maynila ako nagtatrabaho. Yung ninang ko na may
business, binigyan ako ng TIN Forms. Form 1901, take
note. Para sa mga regular employees. May pipirmahan sa
likod ang employer ko. After nito, dumiretso ako sa
baranggay hall namin para sa clearance. Hiningan ako
ng CV para sa file. Medyo naiirita na ako sa puntong
ito. Isipin mo naman kung gaano ka-hassle ang buong
prosesong ito, para saan? Para gawin ko ang aking role
bilang mabuting mamamayan sa pagbabayad ng tamang
buwis. Anyway, tinanong ako nung babae sa baranggay
hall kung may TIN daw ako. Napapalo ako sa noo ko.

Whoooooo!!! I LOVE THIS COUNTRY!!!!!

Okay! So may clearance na ako!

Humingi na ako ng certificate of employment sa bosing
ko, at pinapapirmahan ko na siya sa likod ng Form1901
ko. Kaso sabi niya, hindi raw puwede kasi wala ako sa
roster of employees ng NCCA. Project employee lang ako
e. So tinanong ko kung puwede ibalik yung mga kaltas
sa akin, tutal ala naman akong TIN e, at ayaw akong
bigyan ng BIR, kaya putangina sila, di ko bibigay pera
ko sa gobyerno! Ang problema, hindi raw puwede yun.
Tuloy-tuloy ang kaltas sa suweldo ko. Kapag hindi raw
kasi kinaltasan, sila raw ang malilintikan kapag
nag-check ng expenses ang NCCA, makikitang hindi
binawasan ang suweldo ko. So tinawag ngayon yung isang
accountant ng NCCA para tulungan kami sa aming munting
problema. Hindi rin maintindihan nung accountant kung
bakit hinihigpitan ako ng BIR. Putsa, ako na nga ang
magbibigay ng pera sa gobyerno, may gana pa silang
magpakipot. Sabi nung accountant, yung kinaltas sa
akin, mapupunta pa rin sa gobyerno, may TIN man ako o
wala, at hindi sa bulsa ng kung sinoman sa NCCA.

Well, dadaan muna sa gobyerno, sa BIR, bago mauwi sa
bulsa ng isang congressman, pero technically, alang
problema dahil pagkahaba-haba man ng prusisyon, sa
simbahan pa rin ni satanas ang tuloy. Ang difference
bale, kapag may TIN ako, dinedeclare ko lang na sa
akin galing yung kakaning-ibon na baryang portion ng
pang-tip ni Mr.Congressman sa pokpok niya sa Pegasus.
Otherwise, mula kay Mr. Anonymous yung pang-tip niya.

Advise sa akin, sabihin ko na lang na freelance writer
ako. Tutal, may kaltas din naman daw kapag
nag-freelance ka sa mga diyaryo. Tapos i-assert ko raw
na ako na ang magbibigay ng pera sa kanilang mga letse
sila kaya dapat bigyan pa nila ako ng libreng
chocolait at biskwet out of gratitude mga hayop silang
mga impakto sila.

Okay. So bumalik ulit ako sa BIR Main. As usual, ang
pila lang ay yung sa harap, kung saan nagtse-check
yung sekyu ng bomba sa mga bag ng mga tao. Anyway,
babae na yung nasa desk ngayon. Pinakita ko na yung
baranggay clearance ko, at yung accomplished Form 1901
ko. Nung tinanong sa akin kung saan ako nagwowork,
inexplain ko na freelance writer ako kaya wala akong
regular employer, kaya walang nakapirma sa likod.
Okay?

Okay… Hinde. sabi nung babae, since hindi ako
regular employee, ibang form dapat ang finill-up-an
ko. At bigla siyang naglabas ng Form1902 at binigay sa
akin. Whew, kinabahan ako dun a. Yung Form 1902, sabi
niya, ay para sa mga “mixed-income individuals,” para
sa mga taong hindi regular ang kita- professionals,
businessmen, at sabi niya, freelance writers.

Okay! Fill-up dito, fill-up dun, okay lang!!!
Magkakaroon na ako sa wakas! Inaabot ko na sa babae
yung Form 1902! Eto na…

“Ummm, okay na? Ngayon, punta kayo sa West Ave. Branch
namin.”

Nanlaki ang mata ko. Wow, nasira agad ang aking moment
of triumph.

“Err! , hindi po ba puwede rito sa Main?”

“Hinde, kasi sa Project 6 ka nakatira. West Ave.
Branch namin ang may hawak sa inyo.”

Naramdaman ko, parang umiikot-ikot ang paligid ko.
Parang gumagaan ang ulo ko, nanglalambot at naghihina
ang tuhod ko. Bigla kong naramdaman ang isang
matinding pangangailangan na i-headbutt ang kausap
kong babae sa desk. Sa halip na isang headbutt,
nagtanong na lang ako.

“Puwede po bang ibang tao na lang ang maglakad nito
para sa akin?”

“Oo, gawa ka ng authorization letter…”

Ah! Para akong nabunutan ng tinik sa dibdib! Papalakad
ko na lang ito sa nanay ko. hehehe. Paglabas ko,
marami pa ring tsinecheckan ng bomba sa bag sa harap.
Ngayon alam ko na kung bakit. Ako rin gusto ko rin
silang bombahin.

Hindi ko pa rin mawari, nung araw na yun, kung ano pa
talaga ang purpose ng BIR Main. Nakangsiomai, dun sa
maliliit na branches nila, siksikan ang mga tao,
milya-milya ang pila. Sa Main, ang lawak-lawak, pero
di sila nag-a-accomodate ng applications!

Sa kasamaang palad, hindi ako nakapagsulat ng
authorization letter, at masyadong busy ang nanay ko
para ilakad ang TIN ko. Anyway, sabi niya sa akin, may
kaklase yung tita ko sa BIR West Ave. Kapag nagipit
ako, hanapin ko na lang yun. Okey. Sige. Isa pa, may
Form 1902 na ako, baranggay certificate, at yung
excuse ng aking pagiging freelancer. Pila lang siguro
ang problema, pero okay na. Putsa, dapat okay na.

At nakarating din ako, isang araw, sa BIR West Ave. Sa
second floor sila nag-oopisina sa isang building.
Masikip yung elevator dahil sa dami ng tao. Narating
ko na rin yung desk para sa TIN. Nung chineck nung
babae dun yung papeles ko, hinanap nila yung pirma ng
employer.

“Ay. Wala po. Freelance Writer po ako e.”

Napatingin sa akin yung babae, tinitigan ako sa mata
na wari’y tinitimbang ang mga salitang aking
nasambit…

“Ano yung Freelance Writer?”

Napapalo ako ulit sa noo.

“Ma’am, freelancer po ako. wala po akong regular na
sahod. Binabayaran ako per article na sinusulat ko.
Hindi po ako regular employee kaya wala akong
certificate of employment.”

Nung makitang Form 1902 ang dala ko, sinabihan pa
akong maling form ang bitbit ko, kaya inexplain ko pa
na nanggaling na ako sa BIR Main na Form 1901 ang dala
ko dati pero sabi dun, mali raw ang 1901 para sa akin
kaya binigyan ako ng 1902 dahil freelance writer ako,

sa likod ko. Ipinaliwanag ko ulit.

“Oo nga. Sa second floor ang application ng TIN. Bakit
ka pinaakyat sa akin?”

Halos nagmamaka-awa na ako. “Ma’am, ala po ba talaga
kayong magagawa?”

At inilahad ko ulit yung masasayang adventures ko sa
BIR Main, sa BIR Port Area, sa BIR Main, at sa BIR
nila. Awa ng diyos, may kinuhang chart yung ale,
hinanap yung kategorya ko. Nung makuha yung code,

My employer failed to give me my tax refund which I am currently contesting. Do we have a specific tax law stating this policy that i should be given a tax refund?

Hi Jean, tax refund would come only when your tax that was withheld from your pay is greater than the tax due. Likewise if the tax withheld is lesser than the tax due, you will be required to pay the balance.

Again Employers can make such refund if the amount they withheld from you is greater than the tax due that should be remitted to the BIR.

These things are stated in the BIR form 2316 that our employer’s are required to give us before the April 15 deadline.

For further assistance on this matter you may call the Withholding Tax Division in the BIR National Office. Their numbers are 926-9347 and 926-9351. You may need to have your 2316 certificate with you so you can ask them on the computation of the tax that was withheld from you against the tax due. Just to verify on the accuracy of its computation.

Hello Warwick,

If your an employee intending to put up a business. Then the BIR Form 1901 should be used for the registration of your business.

Documentary requirements are Mayor’s Business permit, DTI permit, birth cert. of dependents, marriage cert. if married. You will be required to pay the Annual Registration Fee of 500 pesos.

This should be filed with the BIR RDO who has jurisdiction over your business address.

If your TIN is registered with another RDO and not in not with the RDO who handles you business address. Then you may need to transfer your TIN to the said RDO who has jurisdiction over your business address. Using BIR Form 1905. Request to transfer your TIN.

I’ve been searching for an answer for quite a while now, and hopefully some one may have an answer. I have been working for just alittle over a year now. Im already working in my second job. My first job was in a small local it company based in Taguig. I started out as an intern, then with a few months I was absorbed and became a fully pledge employee. So officialy I worked there for under 4 months, but the thing is, I was never given a TIN number. So when i left the company and transferred to a new it related company in Quezon city, i was told to apply for a new TIN. So i did, and i can guarantee that what i have now is my first and only Tin. My question is, what happens to me when I file for taxes? I was never given a form 2316 when i left my first company? Is there a procedure i should go through so I can do this the right way? Am I in trouble? What exactly do I do? Hope you guys can help me with this problem of mine, its been bugging me for some time now. Thanks in advance.

Simply lang po tawagan lang po ninyo ang BIRCC or TIN Verification office ng BIR. Ang kanilang mga numero nakalagay lang po sa article na ito. Hihingin lang po ang buong pangalan ninyo at birthdate.

Hello Gab, it just means its your original TIN. Kung may business ka halimbawa at nagkaroon ka ng branches halimbawa.

Ang branch mo may TIN din at instead na 000 ang dulo magiging 001.

O halimbawa na may business ka na gamit ang original TIN mo. at nagpasya ka na magtayo pa uli ng ibang line of business. halimbawa computer shop ang original business mo at nagpasya ka na magtayo naman ng laundry shop.

Yun laundry shop mo magkakaroon ng TIN. Gamit ang original TIN number mo pero ang dulo nun hindi na 000 kungdi 001 na.

Hi Mark, we are still under the substituted filing policy of the BIR.

It is our employer who files and pay our taxes. The 2316 would be our ITR provided we have only one employer for the entire taxable year. Which is 2010 of course.

But if you have two or more employers. We would need the 2316 of our previous employer. Your new employer did request your 2316 from you. did they?

You should request for the 2316 cert. from your first company. Because your new office would certainly require this from you.

Should your first company refuse to give you this 2316. You can file a formal complaint duly received by the RDO who handles the business address of your previous office.

That document can also serve as proof that the problem was not in your end but with your first company.

Thanks for the answer. I think i forgot to post some important details. In my previous company, I was hired as a consultant, so we were charged with 2% with holding tax. The other thing, my current company had me apply for a new tin number since I didnt have one.

So being my first TIN number is it possible to still get a 2316 from my previous employer?

I was told by a friend(not sure if he is 100%), that i should ask for a copy of the creditable with holding tax form from my previous company and file a form 2307 in BIR. Im not sure if this is the case or this is the proper procedure.

Hi Mark, sorry for this late reply. This blog was blocked by our office for reasons I really do not know.

Anyway, yes you may need that form 2307. Your previous employer or client would be much accurate since your not an employee but as you said their consultant.

Companies who hire consultants are required to WITHHELD this CWT so they can remit this to the BIR. Since they withheld 2% from your pay or fee as a consultant. That company should have given you your 2307. this a certificate attesting that they withheld 2% from your pay.

So when you file your ITR. That 2% amount can be deducted in your ITR.

Your friend is correct. You should demand this 2307 certificate as this is the attachment to your ITR as proof once you enter the amount withheld from you.

Hi. My query is that I used to work in Alabang and will now be working in Makati. The HR told me if my RDO does not match theirs (which will probably not) I would have to fill out form 1905 from BIR. Now, I’m not sure which office should I go to, will it be in Makati or Alabang? Also, my BIR TIN ID does not contain my full name and somehow raises legal problems so I’d like to change this as well. My ID, by the way was processed in Cavite as my friend voluntarily processed this when she was still working in BIR. Can I process both concerns in one 1905 form? Also, who will provide me with the new/ updated ID? Help me please, I need to process these, ASAP. Thanks a lot!

Hi, just got my form 1905 processed this morning but I still have a concern, my number was called when I was about to write my name and signature at the back of the form so blank siya when the officer stamped my forms. I asked him if I could still sign on it, sabi nya no need na raw. Kaya lang I’m still worried baka kasi magkaproblema siya or hindi ma-process ng maayos yung transfer na ni-request ko. I hope you can help me with my problem. I am afraid that if I approach a BIR office, baka pagbayarin kagad ako..

I have a TIN since 18 years old, (I am already 35 now), my mom uses my name as owner/proprietess of our family business up to now. I used that TIN number for my drivers license etc and my mom uses it to file the yearly ITR kasi my business kami. So I was a student with an ITR kumbaga. However, when I started work last 2005 and I asked my mom my TIN number, nag-iba na (di ko lang alam kung bakit). So I used the new TIN sa work ko from 2005 to 2008 na ginagamit nung employer to file my tax. So parang nadoble yung ITRs ko noon kasi merong yearly na fina-file mom ko, meron pa yung employer.

My present problem is I’ve been in private practice as a professional for several months na. And I havent filed the quarterly BIR forms kasi I dont know what to do, If i file, dodoble yung ITR ko kasi my mom also files yearly ITR for our family business. Or no need na ko magfile for my private practice? Or do I need to get a separate TIN for myself?

Sorry for this late reply, my office recently blocked this site. BIR Branch or Revenue District office (RDO) you should go to is the BIR office that holds your TIN registration. Yes, the form to use is the BIR form 1905. To know the RDO where your TIN is currently under and the address of the said RDO just call the BIR Contact Center or the TIN Verification office whose numbers are indicated in this article. You need to transfer your TIN registration first to your New RDO. That would be the RDO where your office files their taxes. And that new RDO is where you will file your request for your TIN card using the same form 1905.

If you filed and didnot sign. I’m also a bit concerned. Are you sure that the RDO you passed your 1905 is the one where your TIN is currently registered?

If you have problems knowing it just inform me and lets see what I can do.

Hi Mark, fines or penalties are imposed mainly on late filing. Just go the BIR Revenue District Office where your TIN is currently under. Or you can go their Tax Filing Centers to help or assist you on how you can file your ITR.

Hi Roy, just call the BIR Contact Center or the TIN Verification Office to check if your TIN which RDO in Pasig is it under. RDO 43A or RDO 43B. Or you can call these offices. You can ask the BIR Contact Center for their numbers or you can get it thru the BIR Web. Just click directory and then the Revenue District Offices. You can have your TIN transferred to the RDO in Manila which has jurisdiction of your current employer. You need to file it with your original or old RDO in pasig.

Hi Rain, I can’t seem to understand. You said “I asked my mom my TIN number, nag-iba na (di ko lang alam kung bakit).” You mean to say that your TIN is not the same TIN you used in getting your drivers license? That’s a bit confusing. TINs do not change that easily, its permanent actually unless you requested it to be deleted.

I would suggest you check what TIN is really under your name. Just call the BIR Contact Center or the TIN Verification office. Their numbers are indicated in this article.

Also ask if your TIN is under ITS or One TIME TIN. If its in ITS then it’s a regular TIN. If its registered under One time then you may need to update your TIN. I would like to ask also, is your business registered with the BIR? Because if it is then you should have a Certificate of Registration indicating the taxes you are required to file and pay. And if your mom filed and paid it based on that registration then you do not have any problem regarding non filing.

You can actually file your business income and your income from your compensation under an employer in one form. Mixed Income Earner is the term for those who have a regular day job and a business w/c they own and operate. Its quite common really. The BIR Form to use is the 1701.

Do check this form out and familiarize yourself with it. You can call the Withholding Tax Division to help you out or guide you if you have questions in filling out this form. There numbers are 926-9351/926-9647.

Hi! My name is Mae Ann. My father is a member of a tricycle drivers’ association in Cebu. They were existing for 3 years now and the the local government were asking them for the association’s tax. Reviewing the association’s income report, if they will have to pay for the said tax, they would result to a deficit.
I would like to know if there is a tax imposed to Non-profit NGOs such as the tricycle drivers association?

Hi, how can i confirm if my company is remitting my taxes. I have a tin number but every year kami ang nagaayos ng itr namin at ibibigay lamang sa kanila para sila daw ang reremit. after nun wala ng bumabalik sa amin, yung copy namin walang stamp from BIR.. wala din kaming tax refund kasi po pag nagtanong kami, sinasabi nila sakto daw ang kinakaltas sa amin. Kung posible po ang mga bagay na ito, yun na lang, nireremit ba talaga nila ang taxes namin?

Hi! May we know how to correct the error we made in filing the Monthly Remittance Return of Creditable Income Taxes Withheld (Expanded) - Bir Form No. 1601-E at the wrong RDO. We filed it at RDO 028 but it should be at RDO 052. There is also an error in the TIN No. indicated in the form. The correct TIN no. is 000-003-929-142-000 instead of TIN no. of 223-003-929-142-000.

Good day. I’m going to resign from my current company this April and I’ll be starting in my new company next month. I am afraid that my current employer would not remit may tax to BIR so what would I do to make sure that they would remit it to BIR. And I would also like to know how would I know how much tax do I need to pay during my stay in my company. (January 2011-April 2011). Thanks!

Hi Mae, You mean march 2010 not 2011 I believe. We’re talking about 2010 taxable year. Anyway, if you didn’t disclose it to your new employer then they probably assume you had no work from Jan to March of 2010.

So it is assumed that you have only one employer for the entire year of 2010. Thus the 2316 given to you by your employer is your ITR.

You wish to file? correct me if I’m wrong. Are you intending to file for Jan to Mar of 2010?

Did your new employer gave you your 2316 before the april 15th deadline?

Let me know so I can better understand your situation.

Hi Mae Ann, first the local government is a separate office from the BIR. They collect local municipal taxes.

The BIR collects national internal revenue taxes under our NIRC.

If your association applied to tax incentives for a non profit organization then. The next question would be. Did that association request for a ruling with the Law Division to avail of tax exemptions or to be exempt from taxes?

If they have, then they should know their rights regarding taxes with the BIR.

The local government tax may have been because either you are not exempt from it or the association didn’t apply for an exemption.

Let me sight an example, church organizations are exempt from VAT under our laws. Not because a church is registered as a non profit organization they are already exempt.

They are required by the BIR to register and apply for a ruling with the Law Division of the BIR on the tax privileges for their church. Once granted the church has basis now. without that they will be subject to tax still.

again in your case, you need to check with your local government regarding this matter. I am not familiar with their policies regarding granting of exemptions but I am sure they have one for non profit organizations.

My previous job was last year (2010) to march 2011. I already received my 2010 ITR.

Also, I don’t have 2316.

I just started my new job 3rd week of march 2011 and my new employer assumed that I didn’t have work from jan.-march 2011 since i didn’t disclose it.

No I don’t wish to file an ITR for jan.-march 2010. But if ever i wish to file for an ITR for 2011 taxable year, where can i get 2316? Can I get it to my present employer?

Is there a possibility that I’ll be having problems filing an ITR for 2011? (kasi if ever na magfile ako hindi kasama yung jan.-march 2011)

Hi, our organization, a religious- non-stock non-profit, has been inactive for a few years and currently would like to update/file income tax this year. The Case Monitoring Sheet (CMS) provided by the BIR shows that aside from the Annual Income Tax, we also should submit BIR form 2551M or the Monthly Percentage tax. We learned from the former bookkeeper that they were asked to file BIR 2551M previously, provided, they show proof of charity works. How do we proceed with all these?

Yung RDO ko sa 1st employer ko is RDO 50, and then yung
2nd employer ko is RDO 39, ngayon naman nag aapply ako sa

hindi ko dineclare sa kanila ung 2nd employer ko, so ang akala ng 3rd employer ko naka reg padin ako sa 1st employer ko under RDO 50, since hindi nga nila alam na nag work pa ako sa iba. Ang tanong ko po sir, kase naka reg ako sa RDO 39 po ngayon, kung mag change ba ako sa RDO 50, malalaman ba ng 3rd employer ko ung pinanggalingan ng RDO ko dahil sa form 1902 may nakalagay na change “from” and “to”

pag finile ko po ba un sa BIR hindi sila mag bibigay ng copy nun sa 3rd employer ko? kase pag nalaman nila na RDO 39 ung nasa “from” malalaman nila na may napasukan pa ako na iba after ng 1st employer ko.

tska I just got married palang po, pano po i-update ung married name ko at gusto ko po sana mag apply ng TIN ID.

Hi Matta, dapat po kuni ninyo ang ITR ninyo or yun 2316 certificate. Kahit wala pong stamp ng BIR. Kung mapapansin ninyo ang gawing ibaba ng form ang pinapanagot ng BIR dun at nagaatetest ay ang mga employer.

Dapat po pirmado nila at bigyan kayo nito. Tsaka lang tatakan ng BIR yun kung sa taxable year 2010 halimbawa na dalawa ang naging employer mo. Required na mafile ninyo ito. Pero kung isa lang ang naging employer ninyo.

Hindi kailangan maifile ito at sapat na po ang pirma ng inyong employer sa 2316 cert. Ito po ang nagiging ITR natin.

Pasensiya at sobrang tagal ko nabalikan itong blog na ito. Block na kasi ito sa aming ofc.

Hi Aris, just call your RDO for assistance regarding matter.

You need to amend your return. And letter to your RDO which you said is RDO 52 explaining the incorrect TIN and wrong venue filing of your return. Because there is penalty impose on filing with the wrong venue or RDO.

Using BIR form 0605 Payment Form. Payment on possible penalties which will be imposed.

anyway, you should request for your 2316 cert. this the required to employers when their employees decide to resign from the company.

The employers are required to indicate the taxes they withheld from your pay. They are also the ones attesting to the remittance of this tax.

As an employee it is our employer who are required to withheld and remit this taxes to the BIR.

No, i don’t think you will have problems in filing. Since you only have one employer so to speak since you intend not to disclose your other employer.

Hence, you only have one employer. And that employer will file and give you your 2316 cert. based on the number of months you worked for them.

Hi Joan, you need to talk with the officer in your RDO regarding this matter. there is a penalty for non filing for every time that you did not file.

Since you said you are non profit organization, then you have a ruling from the Law Division on the tax exemptions. If you are unfamiliar you may call the Law Division 927-0963 or 926-5536.

Again, your RDO probably knows the exemption and policies you are under. And the certain requirements you are required to submit and follow.

I suggest you contact your RDO first regarding this matter to assess the thing you may need to do. I really do not have the correct info on your registration and the required or approved exemptions that your organization was given.

So do call them. If you have problems in getting the info you need. Just inform me and I’ll see what I can do.

Hi I’m currently unemployed but I already have a TIN number as arranged by my employer at the former company I work for but I have no TIN card yet. Now that I wish to apply for a Driver’s License, I believe I need to provide them with a tin identification card.

Question: do I need to pass a 1905 form since I’m no longer working and will get a driver’s license soon? If so, how do I update it?

Anyway, your TIN is valid and verifiable. I know the LTO has an access to the BIR TIN database.

But if you really need this. Yes the form to request for a TIN card is the 1905.

In part II of this for “K” write in the box provided TIN CARD. Sign your name at the back of this form and submit to your BIR branch or the RDO where your TIN is registered. Good day.

Submit to the RDO or BIR Branch handling the area of your barangay.

Hi Rene, if your registered as self-employed, your saying may existing business kayo na operating.

At ang sunod na condition ay meron kayong papasukan na trabaho sa isang kompanya.

Mixed Income Earner ang kategorya ninyo.

1902 ang BIR form na gagamitin ninyo. Indicating your TIN. At dapat din po ipa fill up ninyo ang portion para sa EMPLOYER INFORMATION sa authorized rep ng opisina ninyo.

ipa file ito sa RDO or BIR branch na may hawak sa inyong TIN.

I do not know about the consequence your implying. Because your would be employer would likely required you to comply with such registration.

Gudmorning, rene to, self-employed yung nilagay ko s registration form ng bir kahit wala akong business.. gusto ko lang kc mag ka TIN, plan ko kasi dati maging agent ng lote kaso hndi natuloy… tapos na-hire ako sa isang company as call center agent… sa province RDO ako ngregister para s TIN tas yung current work ko ay sa manila. nung ma-hire ako, ang napasa ko lang ay 1905 (update of registration). dapat pala ata ay nagpasa din ako ng 2305 (update of employer) Ang problema, 2 yrs n akong nagtatranaho ng s call center ng laman ko n hnd pla nka-link yung tin ko s current employer ko… at wla daw natatnggap n contribution ang RDO ko s manila… pero every sweldo ko nbabawasan naman ng tax ang sweldo ko… 2 times n din akong nagka ITR… panu yun? anu dapat ko gawin? Hi. The HR of my company gave me the BIR form 1905, saying that I need to go to BIR to change to RDO from 49 to 47.

However, when I went to the BIR to have it changed, they said there was no need for my to update, because there was no change of employer, I didn’t change my address, or my marital status. I said that I only followed what the HR asked me to do.

So I went back to the HR and gave the form, saying that the BIR said there is no need to change the RDO. I checked online, and the office of my company belongs to RDO 47.

Does that mean I have to return to our HR and have the RDO change from 49 to 47? Thank you very much.

I just want to ask, is the 2316 already considered as my ITR?

Also, I have resigned from my employer. I was there from Feb-June this year. My new job is asking me for a 2316 pero I didn’t tell them that I have been employed from Feb-June.

Meron akong existing 2316 from my employer last year-Feb 2011. Hindi pa ako kumukuha ng 2316 from my Feb-June 2011 employer.

Pwede bang ung 2316 ko from last year-Feb 2011 and ibigay ko sa new employer ko kahit na nagtrabaho ako from Feb-June this year? Would it matter or wala namang magiging problema?

Hi Rene, ibig ninyo po bang sabihin nag fill up kayo ng 1901 form para sa SELF EMPLOYED? Nagbayad po ba kayo ng 500 pesos registration fee?

kapag gayon po kasi ang registration ninyo. Meron kayong tax na dapat i-file monthly. At kapag di po ninyo ito ngawa. Nagkakaroon po kayo ng OPEN CASES.

Sana hindi gayun ang registration ninyo kung EMPLOYED naman talagang status ninyo.

Regarding po sa tax na withheld sa inyo buwan buwan ng employer ninyo. Wala pong problema dun. Dapat lang po mabigyan kayo ng 2316 cert ng employer ninyo at the end of a taxable year. Kahit pa iba ang RDO ninyo.

Inuulit ko po hindi po problema yun. Dahil under tayo ng substituted filing.

Ang problema kung hindi ninyo naipa cancel ang SELF EMPLOYED na registration ninyo. Malalaman ninyo na kapag nag request kayo for transfer sa original RDO ninyo, hindi nila ito basta magagawa kung may open case kayo.

Anyway, pa confirm nalang kung ito nga ang status ninyo.

Hi Jess, your RDO is 49 as you said. while your current office is registered with RDO 47.

Which RDO did you went to submit your 1905? is it with RDO 47 or 49.

If you went to RDO 49 then the people their should have accepted and processed your request for transfer.

RDO 47 cannot yet accept any application from you since your TIN is as you implied is still with RDO 49.

Is it correct that you have no change in employer? for if thats true then your saying that your employer might have changed their business address and was previously with RDO 49.

Kindly update me on this concern. So i can better understand your situation. Good day.

Hi Renly, the 2316 you got last Feb 2011 might be for taxable year 2010. Do check this out.

If that is correct then this is not the 2316 your employer is asking you.

Kung hindi mo i-declare ang previous employment mo. Then thats your decision. Inform your employer para hindi kana nila hanapan ng 2316 for the months na nagtrabaho ka sa previous employer mo.

So ang record ng ITR mo will be based only sa current employer mo. So tangal na dun ang mga buwan na kinaltasan ka ng dati mong employer.

If it does not matter to you that your tax payments from your previous employer will not be included in your final 2316 come end of 2011 then its really up to you. Your current employer can’t put this info if you do not supply them the 2316 of your previous employer.

Hi Mylyn, Your knew employer is asking you to transfer your TIN registration from RDO 41- Mandaluyong to RDO 50.

This is just a personal blog. So cannot access data info on Globalland Property. Anyway, what you need to know is if your TIN is really registered in RDO 41.

You can know this by calling the BIR TIN Verifiation ofc or BIRCC. Their numbers are indicated in the article above.

If you’re TIN is indeed registered with RDO 41 then thats where your need to file your request to transfer your TIN to RDO 50.

When your TIN is transferred to RDO 50. Thats when you will file your 2305 update.

Thank you very much for your reply. Yes, I went to RDO 49 to have it transferred to RDO 47, but they said there was no need. Yes, the office of my employer is in RDO 47.

My employer did not have a change of address. I am registered with RDO 49 because that is my current place of residence.

Does this mean I need to go back to RDO 49 and tell them that I need to have it transferred to RDO 47, as per request of my employer?

Hi Renly, sorry for this late reply. If you decide po na di mo na i-declare then ang 2316 na gagawin ng bago mong employer ay batay lang sa inalagi mo sa kanila.

Di ko po alam ang patakaran ng SSS o Philhealth pero sa BIR kasi di po nirerelease ang kahit na anomang dokomento ng pribadong individual. Court order lang po marerelease ito. Hindi po kasi public records ang ating mga records sa BIR.

Hi! I just want to ask how to verify If I have existing TIN already. I worked before at Makati, but then I AWOL for personal reasons. So, I worked there for about 4 months, I’ve been checking my pay slip every now and then but there’s TIN provided during the time I have been employed there. And now I’ll be working again, and I dont know If I have to file a new one or what? I dont know what to do. help!

Hi DJ, ang pa update ng marital status ninyo sa BIR ay gamitin lang po ninyo ang BIR form 1905. Required documentary attachment ay yung Certificate ng Annulment ng inyong kasal ng dati ninyong asawa.

dun po kayo sa 4K “Other Details” ng nasabing form. Dun po ninyo indicate ang pagbabago. At bangitin din ang effectivity ng annulment papers ninyo.

ipasa lang po ninyo ito sa BIR branch kung saan kasalukuyang nakarehistro ang inyong TIN.

Just make a short call to the said offices so you can check if you have a TIN or not. They will ask your full name and birthdate.

Follow up question, I just called the BIR Contact Center and have retrieved my TIN. Its registered in Makati, so how am I gonna transfer my TIN from Makati to Manila? I have forms 1905 and 2305 provided by employer.

Am I gonna be the one who’s gonna file it? Or I could just fill out the forms and let the company process it?

An I have additional question, I see that I had registered TIN already from my first job. But then I awol, so I wasn’t able to get my ITR, supposedly along with my COE. Then, Im unemployed for about 10 months.

I got back to the work force June 21, 2010 and resigned April 2, 2011. I hadn’t submitted my TIN because I was employed by my tito on their company. and it was like contractual basis type.

Now my present employer, requested me to submit another form which is the 2306, that’s the ITR I believe. But I dont have it and I only had my COE. So, what should I do?

Hi again Carmina,

First, you can only file those forms with your current RDO or the RDO where your TIN is currently registered with w/c is Makati. Do read the article on how to transfer. Its the top post on the right side of this blog.

Its either you or your employer. I cannot answer for your employer.

For employees its the 2316 not 2306.

The 2316 is a certificate duly certified and attested by ones employer. So for this, you can only get thru them.

For taxable year 2010. the filing of ITR deadline was April 15th of this year 2011.

For taxable 2011. It would be April 15th following year 2012. You said you resigned April 2, 2011. So that means your employer should have withheld tax from your pay for the months of January - March 2011. So you need to get the 2316 cert. for the months of Jan-Mar 2011 so that your current employer can continue recording your taxes.

If for any reasons you cannot get this or your employer could not provide this. Then you may need to declare with your current employer that you were unemployed so you do not have this 2316.

Please note that the BIR is not the one certifying 2316 forms, its the employers who are required to attest and certify this. As they are the ones withholding taxes from their employees.

sir i lost my TIN number. at di ko narin malaman kung asan na ang form ko ng BIR kung san nkasulat yun. now ang employer ko need daw nila and with a proof. di pwede verbal lang. my problem is holiday on monday and tuesday. but i really need my TIN number very badly. pag di ko nbigay sa knla iyon before tuesday which is start ng work ko ipupull out nila ko sa job training.

i heard na pwede magverify ang TIN and pwede ito mkuha via online. But i dont know how. meron ba tlga? and in case available ba ito even in holidays or weekend so i can get one. please help sir. i need suggestions. And in case sir, tawagan ko ang contact centers ng BIR, 24 hours ba cla and open din ba on holidays. thank you. im hoping for your swift reply.

gusto ko lang po itanong kung nababayaran po yung tax ko.
Currently working po ako sa alabang, nung chineck ko po sa BIR dito sa alabang yung tin ko, sinabi po nila na nasa QC yung RDO ko po. Nakakapagbayad pa ang company na pinagtratrabahuhan ko kahit ang RDO ko eh sa QC pa? late ko narin po kasi nalaman kung ndi ko pa po chineck sa BIR ndi ko pa po malalaman.

Good day Sir. i have a problem po with TIN NUMBER. nagtrabaho po ako sa laguna sa PNCC. di ko po alam if may tin number po ako kasi po wala naman pong tin numbe rna indicated sa ID ko. ngaun po, magkakaron po ako ng trabaho dito sa qc. ni rerequire po nila ang w2 or 2316 bir form from my previous employer at tin number. ang ginawa ko po ay nag apply po ako ng tin ID at nabigyan po ako ng tin number. ang concern ko po ay paano po kung meron talaga akong tin number dati pa? eh kaka apply ko lang po ng bagong number ngaun. saka po pag tumawag po ako sa BIR TIN VER, baka po ang ma retrieve nila ay yung bago kong kaka apply na tin number. nde ko naman po mapuntahan yung dati kong company kasi nag sarado na po sila. sana po matulungan nyo ako. alam ko po na bawal magkaroon ng dalawang tin number. hindi ko po alam kung meron pa ako nung una.

Hi Nikko, you can decide the best choice for you. Ang basis kasi ng transfer is that you have an employer whose RDO is not the same with yours.

The reason behind the transfer is for update purposes on your records. Not on the tax that was withheld but on other matters like update on your employer information, additional dependents that you need to declare, update on marital status etc.

Since sabi mo may balak po kayo lumipat sa Pasig. Then if would be best na ipalipat mo nalang sa Pasig dahil kung ipapalipat ninyo sa Alabang. Pupunta ka pa sa Alabang para magrequest na ipalipat naman sa pasig di po ba?

Again if I were you, ipapalipat ko lang sa Pasig as dun din naman ako talaga mapupunta.

Hi Michael, una mo dapat ginawa ay alamin kung may TIN ka bago po nag-apply.

Wala na tayong magagawa po run ngayon. Dahil nakapag apply na kayo. At nagkaroon na ng TIN.

Alamin mo pa rin kung meron ka ngang TIN dati sa BIR TIN Ver. ofc. At kung meron. Ipa cancel mo yun isa.

Ang form 1905 pa rin po ang gagamitin upang ipa cancel ang TIN. Part II “4D” check box “4″.

ask ko lng po…five years ko na po hindi nagagamit ung TIN no. ko …so my employer ask me to submit my TIN #.ang problema po nasa manila po ko dati nkaregister at ngaun dito na po ko nagwowork sa palawan..

hello sir,
kasi po i need to pass my TIN to my new employer. kaso po hindi ko po alam kung meron na ba ako nito nung nagwork ako last 2006.hindi po kasi ako nainform ng previous employer ko kung meron. kaya po nage-mail po ako sa e-add ng BIR na nakapost dito, I did typed my name and birthdate pero until now po wala naman po response from them. Wala po ako access sa phone kaya po hindi ko sila matawagan.Hindi ko rin po alam kung saang branch pupunta kung saan ba ko nakaregister, if ever na meron,para malaman ung TIN ko.Iniisip ko po na magparegister sa libis qc kung meron pong branch doon ng bir. At download kayo ng BIR form 1905. fill it out tapos i-fax ninyo sa RDO na yun ang 1905 para ma transfer diyan sa Palawan RDO.

Once nalaman ninyo ang RDO ninyo Punta kayo sa site na ito :

Kunin ninyo an telefax number. At tawagan ninyo muna ang RDO ninyo at ipaalam ang intensyin ninyo na magfafax kayo ng 1905 for transfer of TIN ninyo.

3 days more or less nandyan na sa Palawan RDO ang TIN ninyo naka register. Puwede na kayo mag apply ng TIN card dun. 1905 din po ang gagamitin ninyo.

Hi chel, maari ninyong tawagan l BIR TIN Verification Office at 926-8339 this is their updated number or the BIR Contact center at 981-8888.

Di naman po siguro mahirap ito. marami na po tayong pay phone. Kahit sa internet shop meron nito.

Di ko po alam kung ano problema ng email na nakapost dito sa ngayon. kaya po tawagan ninyo nalang itong mga numero na ito para malaman ninyo kung meron kayong TIN.

Sa mga numero sa itaas po malalaman ninyo kung meron kayong TIN, ang actual numero ng TIN at kung saang BIR branch ito naka register.

Madali lang po matrace ang TIN ninyo kung meron kayo. Ang Libis po ata under RDO 40 under ito ng Revenue Region no. 7 sundan ninyo ang link sa ibaba at click ninyo ang Region 7 para makita ninyo ang map location ng naturang opisina.

Hi!

I just want to ask reagrding what best way to correct an information regarding an employee registered through e-reg.

I mistakenly interchanged his name and middle name. With that, what should I do?

I was advised to let him fill-up a 1905. Where does this kind of correction fall among the many “reasons for registration update” in the form. Also, what attachments might be needed in the process.

Good day! I have a TIN issued March 30, 1995 pa po. Nang vinerify ko sa BIR office sa Makati wala daw sa database nila. Ask ko lang po paano pong nangyari yun. Wala na po bang record ang BIR pag more than 16 yrs na. Almost more than 12 yrs na rin akong kinakaltasan ng task.

Hi good morning! Question lang po. I resigned from my previous employer last February 2011, tapos nagkawork po ulit ako nitong April. Sa Ortigas po kasi naka-base yung previous tapos yung new employer ko ay sa Alabang. Pina-file po kasi sa akin yung form 2316 para mailipat daw yung RDO. Hind ko po kasi siya naprocess, ang sabi ng HR ng current employer ko ay magiging default na lang daw na sa kanila nakaregister. Ano pong mangyayari sa naibayad ko frm previous employer? May babayaran ba ako dahil sa di paglipat ng rdo? Thanks

Hi, gooday , I am john, a fresh grad and new in this thing, i have a problem about having two tin nos….it happen na may foundation kami in our church and sinali po ako to be a officer, they requires a tin no….sila po ung nagfile, kaso po nitong na hire po ako kumuha po uli ako ng tin at nabigyan naman po ako, never knowing na meron na po pala ako…days lang po ang interval nung pagkaroon ko ng panibagong tin…wala po kc akong idea,…paano ko po maaayos ito…inosente po talaga ako sa ganitong bagay…huhu…i just graduated…ayo ko pong makulong….

Hindi po yun ang form para sa application para ma transfer ang TIN registration ninyo. Ang BIR Form po na gagamitin ninyo ay 1905.

Kindly read carefully the post above regarding transfer to properly guide on the process.

Ang 2316 ay Certificate of taxes withheld from your pay. So when you resigned dapat nakuha po itong certificate na ito dahil ito ang katibayan ng withholding tax na kinaltas at naremit ng dati mong employer sa buwan na inalagi mo sa kanila sa loob ng taon na ito.

Dahil ang bago mong employer ang magcoconsolidate ng mga taxes mo kasama ang taxes na na withheld sa inyo ng dati mong employer.

Para pagkatapos ng taong 2011. At pagpasok ng taong 2012 bago dumating ang April 15th deadline ay maibigay naman sa iyo ng current employer mo ang consolidated 2316 Certificate.

The certificate attested by your employers is the proof of taxes they withheld and required to remit to BIR. Your employers are the ones being required to remit this not the employees.

Even if your TIN registration is in another RDO or even if one does not have a TIN the employers are required to withheld tax and remit it to the BIR branch who has jurisdiction over their place of business.

I was awol in my previous company that I’ve worked before. When I got a new job, BIR 2316 is one of the requirements they needed. Unfortunately, my previous employer said they can’t give it to me. Is that legal? Is there any other way to get my BIR 2316? Cause my employer right now really needed it.

Hi! I was recently issued a TIN id (which I requested for valid id purposes) using BIR form 1902. However, I am a fresh grad and currently unemployed and all I was asked to submit is a photocopy of my birth certificate and I only filled out the name, address, and date of birth portion.

Is what I did okay and will not make me encounter any problems in the future? I’m worried if my having a TIN id already means that I should be paying taxes already even if I’m still unemployed.

By the way, I really appreciate that you have this so that people can easily get in touch with the BIR and answer queries.

Hi Roe, I regret your name has no link to your email or you have not provided any for me to send it thru that form.

Anyway, You can file a complaint with the BIR handling the business address of your previous employer. Thats an option you can take.

Do you have a contract or document indicating that you were indeed an employee of your former employer? As that can serve as proof you may need to attach to your complaint.

Now, like most people who could not provide their 2316 certificate. The new employer has an option to start you off on the time they hired you. As they may not be able to wait for the said 2316 cert.

This situation happens a lot. Where some employers just never provide this as they do not correctly file their taxes. Once BIR is informed they can investigate and enforce our Tax laws.

On the BIR side they may penalize the said office if found to be neglecting the policy of BIR.

Hi TC, I am a bit surprise that you got a TIN card thru 1902.

As that form requires an EMPLOYER to fill out the EMPLOYER INFORMATION portion of that form.

without that the BIR should not have processed your application. As that portion is needed.

Are you saying that BIR accepted that application 1902 without the EMPLOYER INFORMATION and the authorized signature of the EMPLOYER?

And that form 1902 can only process a TIN under your name.

You can only get a TIN card after you got a TIN number under your name which you will use to apply for a TIN card using BIR form 1905.

So how did you get a TIN card using 1902? Did you filed it yourself?

Anyway, I just want to clear that one. As there are a lot of bogus TIN done by fixers.

Hi! Thank you for your response. What happened is that a family friend works for the BIR in our area and we asked her out of curiosity if I could get a TIN ID just for ID purposes since my school ID is no longer a valid ID since I’m already a graduate and the only valid ID I have aside from that is my passport. That person said that I just need to lend a copy of my birth certificate and pay for the ID (P100). When I got the form, my birth certificate, and the TIN ID, I saw the form was filled out with only my name, address, and date of birth and the taxpayer(employee)/authorized agent signed (that person signed it). By the way, I don’t have any TIN prior to that.

Kinda scared now that I might have done something wrong. Thank you!

Well, if you already got a TIN card and a TIN number.

Verify that with the BIR Contact Center 981-8888 if its valid.

It it is then you don’t have anything to worry about.

Anyway, I regret to inform you that the TIN card is really not a valid ID. As you are well aware your not required to come in and have your pic taken or your fingerprint like for that matter.

Some banks are already aware about this. But there are still establishments who accept it as an ID.

But to be frank it lacks the security or complete features of a valid ID that most agencies requires.

Anyway, should you have any other concerns just post it here.

Hi Liz, the BIR web does not provide this option yet. But you can call the BIR TIN Verification Office at 926-8339 this is their updated number or the BIR Contact center at 981-8888.

Just give them your TIN Number so they can check the RDO code where your TIN is currently registered.

If you do not know your TIN. Then just give them your full name and birth date so they can locate the TIN under your name. And then ask for the RDO code.

hi. hoping that someone could answer my query. :-) I applied for my TIN number in Manila because our employer is DOH-central office. However, I am currently assigned here in Mindanao though we receive our salaries from manila through ATMs. I failed to get my tin card in Manila. Is it possible for me to ask for it in the nearest BIR office from my area of assignment? I mean Is the BIR office/data already “centralized” so I don’t have to go to Manila just to get my TIN ID?.. Hi Kat, If it was not your intention to register as SELF EMPLOYED or SINGLE PROPRIETOR then you may need to CORRECT that registration.

For in that type of registration, you automatically are required to file monthly tax returns for that registration. Failure to do so will automatically generate an OPEN CASE.

This is what happened to a nurse who had no intention to be SELF EMPLOYED but went thru to that process just to get a TIN.

He later wanted to transfer after a year of work with a hospital. Only to find out in the BIR branch that he had OPEN CASES.

So if you did this just recently then do the necessary step to correct your registration with said RDO. You may need to go to the BIR branch. There is no online way to do this.

Information in the Online Registration is clear unless you overlooked that part of the registration. Thats why the BIR believes you understood the process of registering online. They will definitely want to know the reasons of any correction in registration.

They will need a written explanation on this matter for documentation.

As you may well know. You are required to submit certain documents and pay the Annual Registration Fee for SELF EMPLOYED or SINGLE PROPRIETOR.

You can call the BIR Contact Center for additional info or you can call RDO 27 directly so you can clarify what you need to do. Go to this link for their contact numbers:

hello poh….I was working in a call center company here in cebu last 2009 and I was still a student,..They had me file bir…then, 2 months after i was hired, I AWOL…After I graduated from college I was hired in another company I told them that I already filed for tin number but i don’t have the tin number and I cannot get it from my previous employer but they gave me another form to be fill in 2 months after I resigned nah naman…Now, I am working with another company for 3 months nah and they’re asking for my tin number…what should I do, where should I go?

hello, i hope you could answer my inquiry. i have multiple TINs, one i got from work and another 2 from ONETTs, for a total of 3 TINs with different RDOs. and i just found out that having multiple TINs are illegal. all my taxes are duly paid and i have the records to prove it. i just want to cancel my 2 TINs which i got from ONETTs. if i do this, what will happen to the existing records indicated in my 2 TINs which is to be cancelled? will they be retained by the RDOs? or will they be consolidated to my existing TIN? or will they be deleted? bec i’m afraid that i may be taxed again if the BIR records will be deleted. Please help me. thank you so much. an advice on how to go about this things will be really appreciated. thank you again.

Nee,

Previously the LTO did not require TIN for certain individuals thru a memorandum signed by previous LTO Chief and previous BIR Commissioner.

It seems that when they left the people in LTO no longer honored that memorandum as they have a newly installed LTO Chief. Thats why in their web page one of their requirements is a TIN even if one is a student or plain housewife or individual with no work yet.

Do inform the BIR personnel that LTO thru newly installed Chief requires a TIN.

Hi Bob, well you really need to cancel those extra TINs. And your concern is indeed a bit complicated.

For cancellation of TIN:

If those TINs that would be cancelled is with different RDOs then you may need to file with both for this cancellation.

Now for your tax payments using those TINs that would be cancelled. You may need to put into writing addressed to the Chief of each office on your concern. And inform them also what TIN you intend to retain and which RDO it is currently under.

For if those TINs were registered for your business then this may not be just a matter of cancellation. And you may need to settle for the policy on closure of business.

Are the TINs you intend to close registered for a business?

No sir, they are not registered for business. my 2 ONETT TINs were used for buying a property from the place where the RDOs issued the TINs. the TINs were used only for those specific transactions (because i thought it was only for One Time Transaction TIN). i didn’t know that having multiple TINs are illegal. what will happen to my records if i’ll have those TINs cancelled? thank you sir for replying.

Hi Tom,

I changed my tax status (from single to single with one dependent). The company I am working for failed to update their records though I have already submitted (Dec 13, 2011) the documents they needed. They told me that if there will be any tax adjustments, I will receive it on Dec of 2012. Is this practice allowed? Did they violated any BIR rules when they failed to update my tax information and I should have added incorrectly computed my tax withheld?
