
August 25,2009, Tuesday, between 8:30- 9:00 o’clock in the morning, the once serene ambiance of Capiz Province, was suddenly disturbed by the simultaneous live radio and television broadcast of the unexpected closure of three (3) popular business establishments in Roxas City . It came as a surprise and people got mixed reaction on what seems to be an alien invasion made by the Bureau of Internal Revenue. Even the invited Media men and the Police Escorts who came to witness the field operation were caught off-guard when they came face-to-face with “OPLAN KANDADO”.
WTO TRADING, with business location along Roxas Avenue, Roxas City was the first in the line to be visited; officially registered under the name of ANGELITO CORONA, a resident of Palawan and suspected dummy of Kenny Sy who is widely known to be the real owner of the business.
The business had been in operation for almost ten (10) years and was one of the pioneering stores selling very cheap China-made products. It had been apprehended many times for non-issuance of receipts, especially during Christmas time.
The said store is a wholesaler/retailer of fast selling items and despite BIR’s prodding to register it as a VAT Taxpayer, there was some reluctance on the part of its bookkeeper for the reason that most of its purchases were without receipts and therefore no input taxes to claim.
The computed tax assessment of P2,863,063.50 was derived after a 10-day overt surveillance. Prior to the actual “Kandado” WTO was given time to amend its return and reverse the BIR findings aside from the 48-hour notice and a 5-day VAT compliance but in all circumstances the notice remained unheeded.
After WTO, Black & White Supermart, came next. Among the three (3) stores, this establishment owned by Ms. Ellen Apaitan located along Burgos St. Roxas City got the biggest assessment. The Oplan Kandado (O.K.) team arrived at 9:35 in the morning. It was ordered closed after the owner failed to submit supporting documents to dispute the assessment of P64,087,844.55. The involved taxable year was the whole of 2008 and the first quarter of 2009.
B&W Drugstore was the third store ordered locked. It is owned and managed by Mr. Leny Albert Apaitan-brother of Ms. Ellen Apaitan. It is located in the same building with Black & White Supermart. The store owner failed to settle the assessed tax of P1,970,974.09 despite the extended time given. The store was locked at around 10:42 a.m. after all the customers who were already inside were through with their shopping. Upon Mr. Apaitan’s request, BIR considered and allowed a passage for consigned perishable goods to be temporarily moved out.
September 17, 2009. In a welcome development, BIR ARDO Atty. Jose Remi Librilla officially opened WTO TRADING today after they gave an initial down payment of P100,000. Remaining account will be paid on installment . Happily looking over is Mr. Kenny Siy –operator of the said establishment. See phot below:
